S.I. No. 165/2025 - Education (Delegation of Ministerial Functions) Order 2025

Notice of the making of this Statutory Instrument was published in

“Iris Oifigiúil” of 18th April, 2025.

The Government, on the request of the Minister for Education and in exercise of the powers conferred on them by section 2 (1) of the Ministers and Secretaries (Amendment) (No. 2) Act 1977 (No. 28 of 1977), hereby order as follows:

1. This Order may be cited as the Education (Delegation of Ministerial Functions) Order 2025.

2. The powers and duties of the Minister for Education conferred on her by or under the provisions of the enactments specified in the Schedule are delegated to Michael Moynihan, Minister of State at the Department of Education.

SCHEDULE

Section 7 (1)(a) of the Education Act 1998 (No. 51 of 1998), in so far as that paragraph relates to persons with a disability or other special educational needs (both within the meaning of section 2(1) of that Act)

Section 7 (1)(c)(ii) of the Education Act 1998, in so far as it relates to transport services

Subsections (3) and (4) of section 7 of the Education Act 1998, in so far as those subsections relate to the performance of the other functions under that Act delegated by this order

Section 33(i) and (j)(iv) of the Education Act 1998, in so far as those provisions relate to persons with a disability or other special educational needs (both within the meaning of section 2(1) of that Act)

Section 37A (inserted by section 8 of the Education (Admission to Schools) Act 2018 (No. 14 of 2018)) of the Education Act 1998

Sections 21, 22 and 28 of, and Schedule 1 to, the Education for Persons with Special Educational Needs Act 2004 (No. 30 of 2004)
