S.I. No. 458/2025 - Planning and Development (Prescribed Persons - Statutory Plans) Regulations 2025

I, JAMES BROWNE, Minister for Housing, Local Government and Heritage, in exercise of the powers conferred on me by sections 4 (1), 31(1)(b)(vii), 34(3)(h), 54(3)(j), 55(1)(a)(xi) and (15)(c)(x), 58(7)(a)(x) and (18)(c)(x), 75(5)(a)(viii) and 76(5)(a)(ix) of the Planning and Development Act 2024 (No. 34 of 2024), hereby make the following regulations:

Citation

1. These Regulations may be cited as the Planning and Development (Prescribed Persons - Statutory Plans) Regulations 2025.

Definition

2. In these Regulations “Act” means Planning and Development Act 2024 (No. 34 of 2024).

Prescribed persons for purposes of sections 31(1)(b)(vii) of Act and 34(3)(h) of Act

3. The following persons are prescribed for the purposes of sections 31(1)(b)(vii) and 34(3)(h) of the Act, namely—

(a) An Chomhairle Ealaíon,

(b) the Commission,

(c) the Commissioners of Public Works in Ireland,

(d) daa, public limited company,

(e) EirGrid,

(f) Electricity Supply Board,

(g) Enterprise Ireland,

(h) the Environmental Protection Agency,

(i) Fáilte Ireland,

(j) Gas Networks Ireland,

(k) the Health Service Executive,

(l) the Heritage Council,

(m) the Health and Safety Authority,

(n) Irish Air Navigation Service,

(o) the Industrial Development Agency (Ireland),

(p) Inland Fisheries Ireland,

(q) the Land Development Agency,

(r) the Marine Institute,

(s) in the case of a regional assembly whose functional area borders Northern Ireland, any planning authority in Northern Ireland whose functional area is contiguous to the area of the regional assembly,

(t) the National Disability Authority,

(u) in the case of the regional assembly for the Southern Region, Shannon Group, public limited company,

(v) Sport Ireland,

(w) An Taisce — the National Trust for Ireland,

(x) Transport Infrastructure Ireland,

(y) Uisce Éireann,

(z) in the case of a regional assembly whose functional area contains a body of water for which the Loughs Agency has responsibility under the remit of the Loughs Agency, that Agency and

(aa) where a port is in operation within the functional area of a regional assembly, the operator of that port.

Prescribed bodies for purposes of sections 54(3)(j), 55(1)(a)(xi) and (15)(c)(x), 58(7)(a)(x) and (18)(c)(x) of Act.

4. The following bodies are prescribed for the purposes of sections 54(3)(j), 55(1)(a)(xi) and (15)(c)(x), 58(7)(a)(x) and (18)(c)(x) of the Act, namely —

(a) the other Ministers of the Government,

(b) An Chomhairle Ealaíon,

(c) the Commissioners of Public Works in Ireland,

(d) daa, public limited company,

(e) EirGrid,

(f) Electricity Supply Board,

(g) Enterprise Ireland,

(h) the Environmental Protection Agency,

(i) Fáilte Ireland,

(j) Gas Networks Ireland,

(k) the Health Service Executive,

(l) the Heritage Council,

(m) the Health and Safety Authority,

(n) Irish Air Navigation Service,

(o) the Industrial Development Agency (Ireland),

(p) Inland Fisheries Ireland,

(q) the Land Development Agency,

(r) in the case of a planning authority whose functional area contains a body of water under the remit of the Loughs Agency, that agency,

(s) the Marine Institute,

(t) the National Disability Authority,

(u) in the case of a planning authority whose functional area borders Northern Ireland, any planning authority in Northern Ireland whose functional area is contiguous to the area of that planning authority,

(v) any planning authority whose area is contiguous to the functional area to which the development plan relates,

(w) any regional assembly whose region is contiguous to the functional area to which the development plan relates,

(x) where a port is in operation within the functional area of a planning authority, the operator of that port,

(y) in the case of a planning authority any part of whose functional area is situated within the vicinity of Shannon Airport, Shannon Group, public limited company,

(z) Sport Ireland,

(aa) An Taisce — the National Trust for Ireland,

(ab) Transport Infrastructure Ireland,

(ac) Uisce Éireann,

(ad) Waterways Ireland.

Prescribed persons for purposes of section 75(5)(a)(viii) of Act

5. The following persons are prescribed for the purposes of section 75(5)(a)(viii) of the Act, namely—

(a) An Chomhairle Ealaíon,

(b) the Commissioners of Public Works in Ireland,

(c) Enterprise Ireland,

(d) the Environmental Protection Agency,

(e) Fáilte Ireland,

(f) the Heritage Council,

(g) Irish Air Navigation Service,

(h) the Land Development Agency,

(i) the National Disability Authority,

(j) in the case of a planning authority whose functional area borders Northern Ireland, any planning authority in Northern Ireland whose functional area is contiguous to the area of that planning authority,

(k) Transport Infrastructure Ireland,

(l) the case of a planning authority, any part of whose functional area is situated within the vicinity of Shannon Airport, Shannon Group, public limited company,

(m) An Taisce — the National Trust for Ireland,

(n) such of the following persons as the chief executive of the planning authority considers appropriate—

(i) other Ministers of the Government,

(ii) other regional assemblies,

(iii) daa, public limited company,

(iv) EirGrid,

(v) Electricity Supply Board,

(vi) Gas Networks Ireland,

(vii) the Health and Safety Authority,

(viii) the Health Service Executive,

(ix) the Industrial Development Agency (Ireland),

(x) Inland Fisheries Ireland,

(xi) The Loughs Agency,

(xii) the Marine Institute,

(xiii) Sport Ireland,

(xiv) where a port is in operation within the functional area of a planning authority, the operator of that port,

(xv) Uisce Éireann.

Prescribed persons for purposes of section 76(5)(a)(ix) of Act

6. The following persons are prescribed for the purposes of section 76(5)(a)(ix) of the Act, namely—

(a) An Chomhairle Ealaíon,

(b) the Commissioners of Public Works in Ireland,

(c) Enterprise Ireland,

(d) the Environmental Protection Agency,

(e) Fáilte Ireland,

(f) the Heritage Council,

(g) Irish Air Navigation Service,

(h) the Land Development Agency,

(i) the National Disability Authority,

(j) in the case of a planning authority whose functional area borders Northern Ireland, any planning authority in Northern Ireland whose functional area is contiguous to the area of that planning authority,

These Regulations set out the persons or bodies prescribed by the Minister for the purposes of sections 31(1)(b)(vii), 34(3)(h), 54(3)(j), 55(1)(a)(xi) and (15)(c)(x), 58(7)(a)(x) and (18)(c)(x), 75(5)(a)(viii) and 76(5)(a)(ix) of the Planning and Development Act 2024 (No. 34 of 2024).
