S.I. No. 459/2025 - District Court (Order 51) Rules 2025


Notice of the making of this Statutory Instrument was published in

“Iris Oifigiúil” of 7th October, 2025.

The District Court Rules Committee, in exercise of the powers conferred on them by section 91 of the Courts of Justice Act 1924 , section 72 of the Courts of Justice Act 1936 , section 34 of the Courts (Supplemental Provisions) Act 1961 , and section 24 of the Interpretation Act 2005 , with the concurrence of the Minister for Justice, Home Affairs and Migration, make the following rules of court.

1. (1) These Rules, which shall come into operation on the 17th day of October 2025, may be cited as the District Court (Order 51) Rules 2025.

(2) These Rules shall be construed together with the District Court Rules 1997 ( S.I. No. 93 of 1997 ) and all other District Court Rules.

(3) The District Court Rules as amended by these Rules may be cited as the District Court Rules 1997 to 2025.

2. The District Court Rules 1997 ( S.I. No. 93 of 1997 ) are amended by the substitution for rule 3 of Order 51 of the following rule:

3 Permission to execute judgment after six years

3. (1) No judgment may be executed after six years from the date on which it was given or made without permission of the Court.

(2) An application for permission to execute after six years must be made by notice of motion, which must be served on the person sought to be made liable.”

These rules remove from rule 3 of Order 51 the reference to a 12-year time period for execution of a judgment.
