STATUTORY RULES AND ORDERS. 1931. No. 57.

WATERFORD CITY SCHOOL ATTENDANCE COMMITTEES ORDER, 1931.

WHEREAS by virtue of sub-section (8) of section 10 of the School Attendance Act, 1926 (No. 17 of 1926), the Minister for Education, after consultation with the Minister for Local Government and Public Health, is empowered by order to prescribe (amongst other things) the time and mode of appointment of members of the school attendance committee for a school attendance area co-terminous with or included in the county borough of Waterford by the council of the said county borough and by the Minister for Education respectively, and the time of commencement of the period of office of the members of such committee :

AND WHEREAS the Minister for Education has, before making this Order, consulted with the Minister for Local Government and Public Health :

NOW I, John Marcus O'Sullivan, Minister for Education, in exercise of the powers conferred on me by sub-section (8) of section 10 of the School Attendance Act, 1926 (No. 17 of 1926), and of every and any other power me in this behalf enabling do hereby order as follows :—

1. This Order may be cited as the Waterford City School Attendance Committees Order, 1931.

2. The Interpretation Act, 1923 (No. 46 of 1923), applies to the interpretation of this Order in like manner as it applies to the interpretation of an Act of the Oireachtas.

3. In this Order—

the expression " the Minister " means the Minister for Education, the expression " the Act " means the School Attendance Act, 1926 (No. 17 of 1926).

the expression " election year " means the year 1931 or any ensuing third successive year.

the expression " the County Borough " means the county borough of Waterford.

the expression " the Council " means the council of the county borough of Waterford.

4. The following provisions shall have effect in relation to the time and mode of appointment of members of the school attendance committee for a school attendance area co-terminous with or included in the county borough by the council and the Minister respectively, that is to say :—

(a) The council shall elect at a meeting (whether specially summoned for the purpose or not) of such council held before the 31st day of October, 1931, such number of members of such school attendance committee as such council is entitled under the Act so to elect ;

(b) the council shall elect at the quarterly meeting of such council held last before the 31st day of October of every election year (other than the year 1931) such number of members of such school attendance committee as such council is entitled under the Act so to elect and such election shall be part of the first business to be transacted at such quarterly meeting of such council ;

(c) the town clerk of the county borough shall immediately after every election held in pursuance of the foregoing sub-paragraphs send to the Minister the names, addresses and descriptions of the persons elected at such election ;

(d) the Minister shall in every election year before the 31st day of December in such year nominate five persons to be members of such school attendance committee.

5. The term of office of every member (other than a member appointed to fill a casual vacancy) of the school attendance committee for a school attendance area co-terminous with or included in the county borough shall commence on the 1st day of January next following the election or nomination (as the case may be) in accordance with this Order of such member to be a member of such committee.
