STATUTORY RULES AND ORDERS. 1931. No. 63.ORDER OF THE MINISTER FOR AGRICULTURE.

EXPORTATION OF ANIMALS ORDER, 1931.

The Minister for Agriculture, by virtue and in exercise of the powers vested in him by the joint operation of the Agriculture Act, 1931 (No. 8 of 1931), and of the Diseases of Animals Acts, 1894 to 1914, and of every and any other power him in this behalf enabling, hereby orders as follows:—

1 Short Title, Construction, and Citation.

1. This Order may be cited as the Exportation of Animals Order, 1931, and shall be construed as one with the Exportation of Animals (Irish Free State) Order of 1923, and the Exportation of Animals (Food and Water) Order of 1924, and the said three Orders may be cited together as the Exportation of Animals Orders, 1923 to 1931.

2 Commencement.

2. This Order shall come into operation on the twenty-third day of September, 1931.

3 Application of Interpretation Act, 1923 .

3. The Interpretation Act, 1923 (No. 46 of 1923) applies to the interpretation of this Order in like manner as it applies to the interpretation of an Act of the Oireachtas.

4 Definitions.

4. In this Order—

the expression "the Principal Order" means the Exportation of Animals (Irish Free State) Order of 1923;

the expression "Veterinary Inspector" means a Veterinary Inspector of the Minister for Agriculture.

5 Further detection of animals certified free from disease.

5. Where a Veterinary Inspector has given a Certificate that an animal is free from disease in accordance with paragraph (iii) of Article 3 of the Principal Order, such animal shall, notwithstanding anything in the said Article 3, if so required by such Inspector, be detained for such further period as, in the opinion of such Inspector, is necessary for the better enforcement of the provisions of the Principal Order, and shall be so detained either in the place of inspection or, if the Inspector so permits, in such other suitable place as may be specified in a licence of the Inspector, and, for the purpose of detention in such other suitable place, such animal may be moved to such place from the place of inspection.

6 Further detention of animals suffering from infirmity, illness. etc.

6. Where an animal detained and rested in a place of inspection in accordance with paragraph (1) of Article 3 of the Principal Order cannot, in the opinion of a Veterinary Inspector, owing to infirmity, illness, injury, fatigue, or other cause, be carried without unnecessary suffering during the intended passage from a port in Saorstát Éireann, the following provisions shall, notwithstanding anything in the said Article 3, have effect, that is to say—

(a) such animal shall be branded or marked in such manner as such Veterinary Inspector may require for the purpose of subsequent identification, and

(b) such animal shall be detained in the place of inspection for such period as such Veterinary Inspector directs, and shall then, if such Veterinary Inspector so directs, be moved on the licence of such Veterinary Inspector to such other place, and for such further period of detention, as may be considered necessary by such Veterinary Inspector for the better enforcement of the provisions of the Principal Order, and as may be specified in such licence.
