AGRICULTURAL PRODUCE (EGGS) REGULATIONS, 1939.

I, SÉAMAS O RIAIN, Minister for Agriculture, in exercise of the powers conferred on me by the Agricultural Produce (Eggs) Act, 1939 (No. 2 of 1939), and of every and any other power me in this behalf enabling, and, in so far as these Regulations relate to the amount or collection of any fees, with the consent of the Minister for Finance, testified by his official seal affixed hereto, do by this Order make the following regulations:—

1 DEFINITIONS.

1. In these Regulations—

the expression " the Act " means the Agricultural Produce (Eggs) Act, 1939 (No. 2 of 1939) ;

the expression " great hundred " means one hundred and twenty eggs ;

the word " preserved, " when used in relation to eggs, means eggs which are cold stored, sterilised or pickled eggs within the meaning of the next following Article of these Regulations.

2 CLASSIFICATION OF EGGS.

2.—(1) In these Regulations—

the expression " fresh eggs, " when used in relation to hen eggs, means eggs which have not been preserved by any process and have the following characteristics :—

Air space : not exceeding three sixteenths of an inch in depth ;

Yolk: central and faintly but not clearly outlined;

White: translucent and firm ;

Shell: strong and sound, clean, free from stain, and unwashed;

The expression " fresh eggs, " when used in relation to duck eggs, means eggs which have the following characteristics:—

Air space : not exceeding one-fourth of an inch in depth ;

Yolk : visible, but moving slowly;

White : clear and firm;

Shell : strong and sound, clean, and free from stain ;

the expression " second quality eggs " means eggs which are not fresh eggs, but have the following characteristics :—

Air space : not exceeding three eighths of an inch in depth ;

Yolk : visible, moving freely, but clear of the side ;

White : clear, but may be weak ;

Shell : strong and sound, clean, free from stain and, in the case of hen eggs, unwashed ;

the expression " cold stored eggs " means eggs preserved by means of artificial refrigeration, which have the following characteristics :—

Air space : not exceeding three eighths of an inch in depth ;

Yolk : moderately visible and not adhering to the shell ;

White : clear and firm, not weak and watery ;

Shell : strong and sound, clean, free from stain, and unwashed ;

the expression " sterilised eggs " means eggs preserved by storage in an atmosphere of carbon dioxide gas, which have the following characteristics :—

Air space : not exceeding three eighths of an inch in depth ;

Yolk : moderately visible and not adhering to the shell ;

White : clear and firm ;

Shell : strong and sound, clean, free from stain and unwashed ;

the expression " pickled eggs " means eggs preserved by immersion in a saturated solution of lime, waterglass, or other preservative, which have the following characteristics :—

Air space : not exceeding three eighths of an inch in depth ;

Yolk : moderately visible ;

White : clear and firm ;

Shell strong and sound, clean, and free from stain.

(2) Hen eggs or duck eggs shall not be deemed, for the purpose of the foregoing paragraph of this Article, to be fresh eggs or second quality eggs if—

(a) the contents are opaque or black, or

(b) the white is dull, cloudy or streaky, or the yolk cannot be distinguished, or

(c) the yolk is distinctly dark in appearance, flattened in shape and floating near the shell, or

(d) the yolk is anywhere in contact with the shell, or

(e) the egg shows any mould or blood spots.

3 EGGS ACQUISITION FEES.

3. The eggs acquisition fee payable by registered wholesalers under sub-section (1) of section 15 of the act shall be at the rate of twopence on every thirty dozen eggs in respect of which such fee is payable under that sub-section.

4 APPLICATIONS FOR REGISTRATION.

4.—(1) Every application, under Section 18 of the Act, for the registration of premises in the Register of Wholesalers, the Register of Dealers, or the Register of Preservers, shall be made in such one of the forms set out in Schedule No. 1 hereto as is appropriate to the particular application, and shall contain the particulars prescribed by that form.

(2) Every such form of application shall, when duly completed by the applicant, be lodged (together with the amount of the registration fee payable under Section 14 of the Act) with the Minister at his office in Dublin.

5 CONDITIONS FOR REGISTRATION OF PREMISES IN THE REGISTER OF WHOLESALERS.

5.—(1) The appliances and requisites with which, in accordance with paragraph (b) of sub-section (2) of Section 19 of the Act, premises must be equipped in order to be eligible for registration under that sub-section, shall be the following, namely:—

(a) Grading trays,

(b) Grading tables,

(c) Packing tables,

(d) Weighing machines of the types prescribed in Schedule No. 4 hereto or such other types as may be approved by the Minister from time to time.

(e) Testing lamps,

(f) At least one thermometer of such type as may be approved by the Minister from time to time.

(g) Shears,

(h) Stencilling, branding or stamping appliances,

(i) Racks for packing materials,

(j) Packing materials sufficient for use with the number hereinafter prescribed of collection cases and standard cases,

(k) Collection cases (of the type prescribed in Schedule No. 2 hereto) sufficient in number to contain the maximum quantities of eggs collected during any week from producers by the proprietor of the premises,

(l) Standard cases (of the type prescribed in Schedule No. 3 hereto) sufficient in number to meet the maximum requirements of the business for two weeks,

(m) Washable coats and overalls for the staff.

(2) Appliances and requisites referred to in the foregoing paragraph of this Article shall comply with the specifications set out in respect of such appliances and requisites in Schedule No. 4 hereto.

(3) The minimum quantity of eggs which, in accordance with paragraph (c) of sub-section (2) of Section 19 of the Act, must be tested, graded and packed in each week on any premises in order that those premises may be eligible for registration under that subsection, shall be thirty dozen

6 FEE FOR INSPECTION OF REGISTERS.

6. The fee payable, in pursuance of paragraph (a) of sub-section (4) of Section 21 of the Act, for the inspection of a register shall be one shilling.

7 APPLICATIONS FOR REGISTRATION ON DEVOLUTION OR TRANSFER OF PREMISES.

7. Every application, under Section 22 of the Act, for registration as the proprietor of any registered premises on the devolution or transfer of those premises shall be made on such one of the forms set out in Schedule No. 5 hereto as may be applicable to the particular case.

8 PERIODICAL RETURNS BY REGISTERED WHOLESALERS.

8. Every registered wholesaler shall, within seven days from the commencement of every month, make to the Minister at his office in Dublin a return in the form set out in Schedule No. 6 hereto, stating in respect of the previous month the particulars required by that form.

9 REGISTER TO BE KEPT ON REGISTERED PREMISES.

9.—(1) Registered Wholesalers. The register to be kept by registered wholesalers on their registered premises in pursuance of sub-section (1) of Section 26 of the Act shall be kept in the form of six separate books, which shall respectively contain the particulars set out in the forms specified in Parts A, B, C, D, E and F of Schedule No. 7 hereto, in such manner that one only of the said books shall contain exclusively the particulars set out in the form specified in one only of the said Parts.

(2) Registered Dealers.—The registers to be kept by registered dealers on their registered premises in pursuance of paragraphs (a) and (b) of sub-section (2) of the said Section 26 shall be kept respectively in the forms A and B set out in Schedule No. 8 hereto.

(3) Registered Preservers.—The register to be kept by registered preservers in their registered premises in pursuance of sub-section (4) of the said Section 26 shall be kept in the form set out in Schedule No. 9 hereto.

10 APPLICATIONS FOR APPROVAL OF PROPOSED STRUCTURAL ALTERATIONS IN REGISTERED PREMISES.

10. Every application under sub-section (2) of Section 28 of the Act for the approval of the Minister of structural alterations proposed to be made in registered premises shall be made in the form set out in Schedule No. 10 hereto.

11 PRESCRIBED MAXIMUM QUANTITY AND PRESCRIBED MARKS FOR EGGS EXPORTED FOR INCUBATION.

11.—(1) The maximum quantity of eggs which may be exported for purposes of incubation under paragraph (d) of sub-section (1) of Section 30 of the Act, shall be ten dozen.

(2) Every package of eggs exported under the said paragraph shall be marked with the words " Eggs for Hatching, " and the said mark shall either—

(a) be inscribed on the top of the package in red block capital letters at least one inch in height, or

(b) be affixed thereto by means of an adhesive label printed in red block capital letters at least one inch in height.

12 DISPOSAL BY REGISTERED WHOLESALERS OF EGGS WHICH ARE UNFIT FOR HUMAN CONSUMPTION OR EXTERNALLY DIRTY.

12.—The following provisions shall have effect in relation to the disposal by a registered wholesaler of eggs, which when tested on his registered premises are found to be unfit for human consumption or externally dirty, that is to say :—

(a) every such egg shall be marked immediately after testing with the word " unsaleable " in letters not less than one-twelfth of one inch high, enclosed in a circle not less than one half inch in diameter ;

(b) the said mark shall be applied conspicuously in two separate places to the shell of the egg;

(c) the said mark shall be so applied in black ink incapable of removal by boiling ;

(d) all eggs marked in accordance with the foregoing paragraphs of this Article shall, if they are externally dirty, be returned to the registered proprietor or the producer from whom they were acquired, or if such eggs are unfit for human consumption, shall either be so returned or be destroyed.

13 APPLICATIONS FOR LICENCES TO EXPORT EGGS.

13.—(1) Every application under sub-section (1) of Section 33 of the Act for a licence to export a consignment of eggs shall be made in the form set out in Schedule No. 11 hereto.

(2) The fee payable under sub-section (7) of the said Section 33 on every such application shall—

(a) if the consignment specified in the licence does not contain more than thirty dozen eggs, be two pence, and

(b)if the said consignment contains more than thirty dozen eggs, be two pence on every thirty dozen or part of thirty dozen eggs.

(3) Every such application duly completed by the applicant shall be lodged, together with the appropriate fee, with the Minister at his office in Dublin, at least two days before the date on which the applicant desires to export the consignment of eggs to which such application relates.

14 TESTING OF EGGS BY REGISTERED WHOLESALERS.

14.—(1) All eggs acquired by a registered wholesaler shall be tested on his registered premises for quality, soundness and cleanliness within a period of 48 hours from the time at which they were acquired, excluding from the reckoning of such period any Sunday or any public or Church holiday on which no work is done on the premises.

(2) All eggs to be tested on registered wholesaler's premises shall be tested in the following method and manner, that is to say—

(a) such eggs shall be tested by a testing lamp of the type described in Schedule No. 4 hereto or by such other type of apparatus as the Minister may from time to time, approve, either generally or in any particular case ;

(b) the said testing lamp or other approved apparatus shall either—

(i) be operated in a room or other part of the said registered premises from which light has been sufficiently excluded for the purpose of such operation, or

(ii) be fixed in a special type of frame-work known to the trade as a daylight tester, or

(iii) be fixed to any other type of frame-work or apparatus approved by the Minister;

(c) during the process of testing, each egg shall be held with the large end towards the beam of light from the testing lamp or other apparatus, and shall be turned completely round so as to permit the whole egg to be examined.

15 GRADING OF EGGS.

15.—(1) Eggs sold, or offered or consigned for sale on or from registered wholesaler's premises shall, before being so sold, offered or consigned for sale, be graded into the following classes :—

Fresh Eggs.

Preserved eggs.

Second quality eggs.

Duck eggs.

Ducks.

(2) Fresh eggs—

(a) " Specials " shall mean fresh hen eggs so selected that no individual egg shall be included which weighs less than 2 oz. 3 drams and that the weight of each great hundred eggs shall not be less than 17 lb.

(b) " Standard " shall mean fresh hen eggs of reasonably uniform size so selected that no individual egg shall be included which weighs less than 1 oz. 15 drams and that the weight of each great hundred eggs shall not be less than 15½ lb.

(c) " Selected " shall mean fresh hen eggs of reasonably uniform size so selected that no individual egg shall be included which weighs less than 1 oz. 12 drams and that the weight of each great hundred eggs shall not be less than 14 lb.

(d) " Pullets " shall mean fresh hen eggs of reasonably uniform size so selected that no individual egg shall be included which weighs less than 1 oz. 9 drams and that the weight of each great hundred eggs shall not be less than 12 lb.

(3) Preserved eggs—

(a) " Specials Cold Stored " shall mean cold stored eggs so selected that no individual egg shall be included which weighs less than 2 oz. 3 drams and that the weight of each great hundred eggs shall not be less than 17 lb.

(b) " Standard Cold Stored " shall mean cold stored eggs of reasonably uniform size so selected that no individual egg shall be included which weighs less than 1 oz. 15 drams and that the weight of each great hundred eggs shall not be less than 15½ lb.

(c) " Selected Cold Stored " shall mean cold stored eggs of reasonably uniform size so selected that no individual egg shall be included which weighs less than 1 oz. 12 drams and that the weight of each great hundred eggs shall not be less than 14 lb.

(d) " Pullets Cold Stored " shall mean cold stored eggs of reasonably uniform size so selected that no individual egg shall be included which weighs less than 1 oz. 9 drams and that the weight of each great hundred eggs shall not be less than 12 lb.

(e) " Specials Sterilised " shall mean sterilised eggs of reasonably uniform size so selected that no individual egg shall be included which weighs less than 2 oz. 3 drams and that the weight of each great hundred eggs shall not be less than 17 lb.

(f) " Standard Sterilised " shall mean sterilised eggs of reasonably uniform size so selected that no individual egg shall be included which weighs less than 1 oz. 15 drams and that the weight of each great hundred eggs shall not be less than 15½ lb.

(g) " Selected Sterilised " shall mean sterilised eggs of reasonably uniform size so selected that no individual egg shall be included which weighs less than 1 oz. 12 drams and that the weight of each great hundred eggs shall not be less than 14 lb.

(h) " Pullets Sterilised " shall mean sterilised eggs of reasonably uniform size so selected that no individual egg shall be included which weighs less than 1 oz. 9 drams and that the weight of each great hundred eggs shall not be less than 12 lb.

(i) " Specials Pickled " shall mean pickled eggs of reasonably uniform size so selected that no individual egg shall be included which weighs less than 2 oz. 3 drams and that the weight of each great hundred eggs shall not be less than 17 lb.

(j) " Standard Pickled " shall mean pickled eggs of reasonably uniform size so selected that no individual egg shall be included which weighs less than 1 oz. 15 drams and that the weight of each great hundred eggs shall not be less than 15½ lb.

(k) " Selected Pickled " shall mean pickled eggs of reasonably uniform size so selected that no individual egg shall be included which weighs less than 1 oz. 12 drams and that the weight of each great hundred eggs shall not be less than 14 lb.

(l) " Pullets Pickled " shall mean pickled eggs of reasonably uniform size so selected that no individual egg shall be included which weighs less than 1 oz. 9 drams and that the weight of each great hundred eggs shall not be less than 12 lb.

(4) Second quality eggs—

(a) " Second Quality " eggs shall be so selected that no individual egg shall be included which weighs less than 1 oz. 11 drams.

(b) " Second Quality Cold Stored " shall mean cold stored eggs of second quality so selected that no individual egg shall be included which weighs less than 1 oz. 11 drams.

(c) " Second Quality Sterilised " shall mean sterilised eggs of second quality so selected that no individual egg shall be included which weighs less than 1 oz. 11 drams.

(d) " Second Quality Pickled " shall mean pickled eggs of second quality so selected that no individual egg shall be included that weighs less than 1 oz. 11 drams.

(5) Duck eggs—

" Ducks " shall mean duck eggs.

16 MARKING OF EGGS CONSIGNED FROM REGISTERED WHOLESALER'S PREMISES.

16.—(1) All fresh eggs (except eggs sold under licence) consigned from registered wholesaler's premises to any place, whether in or outside Ireland, shall be marked, before being packed prior to despatch from those premises, with the following marks, that is to say :—

(a) with a mark (in these Regulations referred to as the origin mark) consisting of the word " ÉIRE " and the word " IRISH " in capital letters one twelfth of one inch high, and

(b) with a mark (in these Regulations referred to as the code mark) consisting of letters or figures or a combination thereof not less than one tenth of one inch high to indicate the period during which such eggs were tested on those premises.

(2) The code mark shall—

(a) in the case of fresh eggs and second quality eggs (other than cold stored or sterilised eggs), be such distinctive mark as shall, from time to time, be appointed by the Minister, in pursuance of sub-section (6) of Section 38 of the Act, to indicate particular periods, and

(b) in the case of cold stored and sterilised eggs, be the code mark which, under the foregoing sub-paragraph, was appointed to indicate the period during which such eggs were tested prior to being cold stored or chemically preserved, as the case may be.

(3) The origin mark and the code mark shall be enclosed in a circle not less than one half inch in diameter in the manner indicated by the following pattern, thus :—

(4) All preserved eggs consigned from registered wholesalers premises to any place, whether in or outside Ireland, shall, before being so consigned, be marked with such of the following marks as is appropriate, that is to say :—

(a) in all cases, with the origin mark ;

(b) in the case of cold stored and sterilised eggs (but not pickled eggs), with the code mark ;

(c) in all cases, unless such eggs are already so marked, with a mark (in these Regulations called the preserved mark) consisting of whichever of the following words is appropriate to indicate the method by which such eggs have been preserved, namely :—

(i) the word " chilled, " in the case of cold stored eggs,

(ii) the word " sterilised " in the case of sterilised eggs,

(iii) the word " pickled " in the case of pickled eggs.

(d) if such eggs are of second quality, with the second quality mark.

(5) The preserved mark shall be applied in letters not less than one sixteenth of one inch high enclosed in a circle not less than one half inch in diameter, in the manner indicated by the following pattern, thus :—

(6) All second quality eggs consigned from registered wholesaler's premises to any place whether in or outside Ireland, shall be marked immediately after being tested and, whether they are or are not preserved, with the following marks, that is to say :—

(a) with the origin mark, and

(b) where appropriate, with the code mark and the appropriate preserved mark, and

(c) with a mark (in these Regulations referred to as the second quality mark) consisting of the words " second quality " in letters not less than one sixteenth of one inch high enclosed in a circle not less than one half inch in diameter, in the manner indicated by the following pattern, thus :—

(7) All marks with which eggs are by this Article required to be marked shall—

(a) be applied conspicuously, in durable ink, to the shell of the egg, and

(b) be clearly and sharply defined, and

(c) unless otherwise indicated by these Regulations, be separate from each other and from any other mark on the egg.

(8) The ink in which marks prescribed by this Article shall be applied shall be as follows, that is to say :—

(a) in the case of preserved eggs black ink, and

(b) in the case of all other egg, when packed during the period beginning on any 1st day of September and ending on the 14th day of March next following, red ink, and when packed during the rest of the year, black ink.

17 PACKING OF EGGS.

17.—(1) On registered wholesalers premises, eggs shall be packed by hand only, in packages (in these Regulations referred to as " standard cases ") constructed in accordance with the specifications set out in Schedule No. 3 hereto.

(2) The following provisions shall apply to the packing materials to be used in standard cases Nos. 1 and 2 (as specified in the said Schedule), that is to say :—

(a) such packing material shall be clean, dry and free from mustiness, mould or objectionable odour ;

(b) it shall consist of either or both the following substances

(i) straw which is flexible and free from coarseness or weeds, or

(ii) white wood wool, not less than one-eighth of one inch in calibre ;

(c) the minimum quantity of such packing material to be used shall be eight pounds of straw or of straw and wood wool, or six pounds of wood wool for every thirty dozen eggs;

(d) such packing material shall be evenly spread above and below each layer of eggs, and at the top, bottom, sides and ends of the case, in such manner and quantity as to prevent any layer of eggs being disturbed in the ordinary course of transit.

(3) The following provisions shall apply to the packing materials to be used in standard cases No. 3 and No. 3 (large) (as specified in the Schedule No. 3 hereto), that is to say :—

(a) they shall consist of fillers, flats and pads of the dimensions, description and quality set out in Schedule No. 12 hereto, or of such other description and quality as may be approved by the Minister from time to time ;

(b) a flat shall be placed between each pair of fillers, and beneath each bottom filler and above each top filler shall be placed a pad of the type, description and quality set out in Schedule No. 12 hereto.

(4) No package which has previously been used for any purpose shall be used for packing eggs on registered wholesalers premises, unless such package has branded on both sides thereof the words " NOT FOR EXPORT " in block capital letters at least three inches in height, and is used solely for consignment to any place within Ireland.

(5) There shall not be packed in the same package—

(a) hen eggs with duck eggs,

(b) hen eggs of one grade with hen eggs of any other grade.

(6) Every registered wholesaler shall place in every package of eggs intended to be consigned by him to any place, whether in or outside Ireland, before it is consigned, a document in the form prescribed in Schedule No. 13 hereto.

(7) Eggs which are, for any reason, ineligible for inclusion in any of the grades specified in Article 15 of these Regulations, shall not be packed on registered wholesalers' premises.

18 MARKING OF PACKAGES.

18.—(1) Every package of eggs consigned from any registered wholesaler's premises to any place, whether in or outside Ireland, shall bear the following marks, that is to say :—

(a) a mark (in this Article referred to as the grade mark) consisting of whichever of the following expressions is appropriate to the grade of the eggs contained in the package :—

(b) a mark (in this Article referred to as the nationality mark) consisting of the words ÉIRE IRISH ;

(c) a mark (in this Article referred to as the transport mark) consisting of the words: EGGS—THIS SIDE UP ;

(d) a mark (in this Article referred to as the identification mark) consisting of the identification letter and number assigned to the premises from which the eggs are consigned ;

(e) a mark (in this Article referred to as the quantity mark) consisting of a number together with the letters HND indicating the quantity (in great hundreds) of eggs in the package ;

(f) if the package is intended to be consigned to a place outside Ireland, a mark (in this Article referred to as the date of export mark) consisting of figures indicating, by reference to the day, the month and the last figure of the year, the date of export of the package from the registered premises on which it was packed.

(2) All letters and figures constituting any mark prescribed by the foregoing paragraph shall have the following dimensions, that is to say :—

(a) all such letters and figures shall be at least one inch high in block type ;

(b) the total width of the space taken by every such letter or figure, except the letter I and the figure 1, shall be at least one half inch ;

(3) The marks prescribed by this Article shall be applied to the packages to which they are applicable in the following manner, that is to say :—

(a) all such marks shall be applied to the package by stamping or stencilling the same in a clear and legible manner and except where otherwise stated in this paragraph, on the outside of the package ;

(b) in all cases, the transport mark shall be applied to the top boards of the package ;

(c) in the case of standard package No. 1—

(i) the grade mark and the quantity mark shall be applied to the upper board at each end of the package ;

(ii) the nationality mark and the identification mark shall be applied to the lower board at each end of the package ;

(iii) the date of export mark shall be applied to a lower side board of each compartment of the package ;

(d) in the case of standard package No. 2—

(i) the grade mark, and the quantity mark shall be applied to the upper board at each end of the package ;

(ii) the nationality mark and the identification mark shall be applied to the lower board at each end of the package ;

(iii) the date of export mark shall be applied to a lower side board of the package ;

(e) in the case of standard packages No. 3 and No. 3 (large)—

(i) the grade mark and the quantity mark shall be applied to the top board at each end of the package ;

(ii) the nationality mark shall be applied to the lower board at each end of the package ;

(iii) the identification mark shall be applied to the centre of the middle board at each end of the package ;

(iv) the date of export mark shall be applied to a lower side board of the package ;

(f) the marks referred to in the foregoing sub-paragraphs of this paragraph, shall be applied in the manner illustrated in Schedule No. 3 hereto ;

(g) in the case of cold stored, sterilised, or pickled eggs, the words " Cold stored," " Sterilised," or " Pickled " (as the case may be) shall be applied to the inside of the end of the package.

(4) The colours in which the marks prescribed by this Article shall be applied to the package to which they are applicable shall be the same as the colour of the ink with which, in accordance with paragraph (8) of Article 16 of these Regulations, the eggs packed in such package are required to be marked.

19 PRESCRIBED PERIOD FOR EXAMINATION OF EGGS BY RETAILERS.

19. The period within which eggs are to be examined by retailers, within the meaning of sub-section (5) of Section 42, sub-section (4) of Section 48, and sub-section (5) of Section 49 of the Act, shall be forty-eight hours from the acquisition thereof, excluding from the reckoning of such period any Sunday or any public or Church holiday on which no work is done on the premises of a retailer.

20 PROTECTION OF EGGS FROM WEATHER AND CONTAMINATION.

20.—(1) Eggs shall not be sold, or offered or exposed for sale, or kept or stored pending sale in any building, vehicle or other place which does not, or under conditions which do not, afford adequate protection to the eggs against wet, damp, dirt, and heat and against adverse weather conditions and against contamination of any sort.

(2) Eggs intended for sale shall, while stored or kept and while being offered or exposed for sale, and while in course of packing or transport, be adequately protected against wet, damp, dirt and heat, and against contamination of any sort, and for that purpose,

(a) the buildings, vehicles and other places in which such eggs are contained during the said periods, shall be clean, cool, dry, well ventilated and so situated and used that the eggs shall not be exposed to wet, damp, heat or dirt or to contamination of any kind, and

(b) all vehicles used for the collection and transport of such eggs shall be suitably covered so as to afford adequate protection for the eggs against wet, damp, heat and dirt, and

(c) the packing materials used for packing eggs intended for sale, shall be clean, dry, and free from mustiness, mould or objectionable odour.

21 PACKING AND DOCKETING OF EGGS COLLECTED FROM PRODUCERS.

21.—(1) All registered wholesalers and registered dealers who acquire, whether at their registered premises or elsewhere, eggs from producers shall place such eggs, immediately upon the acquisition thereof, in a container (in this Article referred to as a standard collection case) of the design, dimensions, and materials specified in Schedule No. 2 hereto and obtained from one of the manufacturers specified in Schedule No. 14 hereto.

(2) Eggs placed in a standard collection case in accordance with the foregoing paragraph of this Article shall be packed in that case in the following manner, that is to say :—

(a) such eggs shall be packed by a packer who shall place himself at the end marked " A " (in the said Schedule No. 2) of the said case, with that mark on his left hand side, and shall pack the eggs from left to right in the near compartment commencing at the centre board ;

(b) when the near compartment is packed, the packer shall proceed to the other end of the case so that the mark " B," at that end, is on his left hand side, and shall then pack the second compartment from left to right beginning at the centre board ;

(c) flats shall be used for packing such eggs and shall be of the " Mapes," " Diamond," or " Keyes Filler " types.

(3) A docket in the form set out in Schedule No. 15 hereto and containing the particulars specified therein shall be made out in triplicate at the time the eggs acquired from any producer are packed in accordance with this Article, and the three parts of such docket shall be dealt with in the following manner, that is to say :—

(a) the original of such docket shall be placed in the compartment of the filler containing the last egg of each producer's lot packed in the standard collection case, and

(b) the first copy thereof shall be left with such producer, and

(c) the second copy thereof shall be retained by the registered wholesaler or registered dealer who acquires the eggs, and

(d) the said second copy shall be so retained for a period of not less than eight weeks and shall be available for inspection by an inspector, and

(e) when the eggs are removed from each standard collection case on the premises of a registered wholesaler, the original of every such docket contained in such case shall also be removed and shall be retained by such registered wholesaler for a period of four weeks from the date on which it was so removed, unless during that period it is taken by an inspector, and shall be so retained in such manner as to distinguish clearly between—

(i) the dockets contained in each standard collection case ;

(ii) the dockets relating to eggs acquired directly from producers ;

(iii) the dockets relating to eggs acquired from registered dealers ;

(iv) the dockets relating to eggs acquired under licence from other registered wholesalers;

(f) as soon as the eggs of each producer's lot are removed from any standard collection case to be tested on the premises of a registered wholesaler, that registered wholesaler shall immediately after testing enter on the back of the appropriate docket removed from such standard collection case under the immediately preceding sub-paragraph the particulars specified thereon.

(4) Hen eggs shall not be packed in the same standard collection case with duck eggs.

22 MARKING OF SECOND QUALITY EGGS INTENDED FOR SALE BY RETAIL.

22. All second quality eggs which are intended to be sold or offered or exposed for sale by retail shall be marked before being so sold or offered or exposed for sale with the second quality mark in the manner prescribed by these Regulations for the marking of second quality eggs on registered wholesaler's premises with the modification that the words " packed " in sub-paragraph (b) of paragraph (8) of Article 16 of these Regulations shall be construed as meaning " examined."

23 MARKING OF EGGS ACQUIRED BY RETAILERS FROM PRODUCERS FOR SALE BY RETAIL.

23—(1) Subject to the provisions of this Article, all eggs acquired from a producer by any retailer for sale by retail shall, within the time prescribed by Article 19 of these Regulations for the examining of eggs by retailers, be marked with a mark (in this Article referred to as the retail code mark) to indicate the period during which such eggs were examined on the premises of such retailer.

(2) The retail code mark shall be such distinctive mark as shall, from time to time, be appointed by the Minister, in pursuance of sub-section (2) of Section 52 of the Act, to indicate particular periods.

(3) The retail code mark shall consist of letters and figures or a combination thereof not less than one-tenth of an inch high enclosed in a circle not less than one half inch in diameter in the manner indicated by the following pattern, thus :—

(4) The retail code mark shall be applied to the eggs to which it is applicable in the manner prescribed by paragraphs (7) and (8) of Article 16 of these Regulations for the marking of eggs on registered wholesalers' premises, with the modification that in sub-paragraph (b) of the said paragraph (8) the words " packed " shall be construed as meaning " examined."

(5) This Article shall not apply to eggs which have been clearly and legibly marked in durable ink by the producer on whose premises they were produced with the name of those premises and the date upon which such eggs were despatched therefrom.

24 MAXIMUM PERIODS FOR KEEPING EGGS ON REGISTERED PREMISES.

24.—(1) Registered Wholesalers. Eggs shall not be kept on registered wholesalers premises for a period exceeding seventy-two hours from the time such eggs were acquired, unless such eggs are unfit for human consumption or externally dirty and have been marked and set aside for disposal in the manner prescribed by these Regulations for eggs of that description.

(2) Registered Dealers. Eggs shall not be kept on premises registered in the Register of Dealers for a period exceeding seventy-two hours from the time such eggs were acquired.

(3) In computing for the purposes of either of the foregoing paragraphs of this Article the period of seventy-two hours mentioned therein, no account shall be taken of any Sunday or any public or Church holiday on which no work is done on the registered premises in respect of which such period is being so computed.

25 MARKING OF EGGS SENT OR CONSIGNED TO OR REMOVED FROM PREMISES REGISTERED IN THE REGISTER OF PRESERVERS.

25.—(1) All eggs, other than eggs intended to be preserved by immersion in a saturated solution of lime, or in waterglass or other preservative, sent or consigned to premises registered in the Register of Preservers, shall, before being so sent or consigned, be marked with a mark consisting of whichever of the following words is appropriate, that is to say :—

(a) the word " chilled ", if the eggs are intended to be preserved by means of artificial refrigeration, or

(b) the word " sterilised ", if the eggs are intended to be preserved by storage in an atmosphere of carbon dioxide gas.

(2) The aforesaid marks shall be applied to the eggs to which, under this Article, they are applicable in the manner prescribed by these Regulations for the application of the preserved mark to preserved eggs consigned from registered wholesaler's premises.

(3) All preserved eggs removed from premises registered in the Register of Preservers shall, before being so removed, be marked (unless they are already marked in accordance with the foregoing paragraphs of this Article) with the preserved mark appropriate to indicate the method by which such eggs have been preserved, and the said mark shall be applied to such eggs in the manner prescribed by these Regulations for the application of the preserved mark to preserved eggs consigned from registered wholesaler's premises.

26 REVOCATION OF FORMER REGULATIONS.

26. The several Regulations mentioned in Schedule No. 16 hereto are hereby revoked as from the date upon which these Regulations come into operation.

27 COMMENCEMENT.

27. These Regulations shall come into operation on the 1st day of September, 1939.

28 SHORT TITLE.

28. These Regulations may be cited as the Agricultural Produce (Eggs) Regulations, 1939.

SCHEDULE No. 2.

METHOD OF CONSTRUCTION OF STANDARD COLLECTION CASES.

PART I.—COLLECTION CASE NO. I.

Standard Collection Case No. 1 fitted with fillers, flats and pads of the descriptions and quality set out in the Twelfth Schedule hereto shall be used to hold not more than 3 hnd. (360) eggs, weighing not more than 16 lb. per 120. Each compartment shall hold 180 eggs.

Description.

The case shall be made with two equal compartments and in accordance with the following specification :—

PART II.—COLLECTION CASE NO. 2.

Collection Case No. 2 fitted with fillers, flats and pads of the sizes, descriptions and quality set out in the Twelfth Schedule hereto shall be used to hold not more than 3 hnd. (360) hen eggs and duck eggs weighing not more than 17 lb. per 120. Each compartment shall hold 180 eggs.

Description.

The case shall be made with two equal compartments and in accordance with the following specification:—

PART III.—GENERAL.

1. Material.

White deal T. & G. (all except centre board) thoroughly well seasoned, smooth sawn or planed, clean, dry, free from wane and feather, large knots and discoloration.

2. Spacing.

There shall be no spacing between the boards. The case shall be proof against dust and rain.

There shall not be more than two boards in the side, in the centre and in the bottom or top of the case and no board shall be less than 4 inches in width. To the bottom of the end boards on the outside of each end of the case a cross batten 2½ inches wide and 7/16 inch thick shall be nailed. One and a quarter inches from the top of the end boards on the outside of each end of the case a cross batten 1½ inches wide by ¾ inch thick shall be nailed.

Cross battens measuring 1¼ inches wide and ¾ inch thick shall be fixed across the ends of the lid on the under side.

3. Nails and Nailing.

The nails shall be 1½ inches 14 gauge and cement coated and not less than eighty-four nails to a case.

4. Lid Fastener.

A hook shall be fitted in the centre of each of the cross battens of the lid so as to pass through a slot cut for the purpose in each of the cross battens at the top of the ends of the case, so that when the hook is turned parallel to and underneath the batten the lid is securely fastened to the case. The hook shall be of 8 gauge wire, 4 inches in length, turned at right angles 1 inch from the end. The head of the hook shall be sufficiently large to prevent the hook from working loose in the wood.

5. Wiring.

The case shall be bound at both ends and centre with 10 by 16 gauge galvanised crescent wire. The wire shall overlap by not less than 2 inches at each end. The wire shall be securely fastened to the case by not less than two galvanised wire staples in each board. The staples shall be ¾ inch long and of 15 gauge.

6. Varnishing.

The outside of all boards in the case and lid shall be varnished.

7. Marking.

Each case shall be branded or printed (not stencilled) with the following marks :—

(1) Letter A on the left hand side of the bottom cross batten on one end and the letter B on the left hand side of the bottom cross batten of the other end.

(2) The words EGGS WITH CARE on the outside of the lid. In addition the words NOT FOR DUCK EGGS shall also be branded or printed on the under side of the lid of the No. 1 case.

(3) Each case shall be numbered consecutively on both ends by means of printing. The series of numbers to be used by each manufacturer will be supplied by the Minister.

(4) The name of the owner of the case and/or the identification number of the owners registered premises may be printed on one or both sides of the case.

8. Label Holder.

A label holder to hold a label measuring 3¼ inches by 2¾ inches shall be fixed on the end marked B shown in the accompanying illustration contained in Part I of this Schedule. The label shall show the name and identification mark of the registered proprietor who collected and despatched the eggs and the date on which the eggs were despatched.

SCHEDULE No. 3.

METHOD OF CONSTRUCTION OF STANDARD CASES.

PART I.—STANDARD CASE. NO. 1

1. Standard Egg Case No. 1 shall be used to hold not more than 6 hnd. (720) hen eggs, weighing less than 18 lb. per 120, or 5 hnd. (600) hen eggs weighing 18 lb. or more per 120, or 5 hnd. (600) duck eggs weighing 18 lb. or more per 120.

Each compartment shall hold 3 hnd. (360) hen eggs weighing less than 18 lb. per 120, packed in three layers, each containing 10 rows of eggs with 12 eggs in each row ; or 2½ hnd. (300) hen eggs, weighing 18 lb. or more per 120 ; or 2½ hnd. (300) duck eggs, weighing 18 lb. or more per 120, packed in three layers, each containing 9 rows of eggs with 11 eggs in each row and one odd.

2. Description.

The case shall be made with two equal compartments and in accordance with the following specification:—

Spacing between any two adjoining top, bottom, side and end boards nowhere to exceed 1 inch.

Saw space not exceeding ¼ inch must be provided between centre division boards.

The internal dimensions and thicknesses of timber mentioned in this specification are minimum dimensions ; all timber thicknesses are actual, not nominal.

3. Timber.

The wood shall be well seasoned and free from odour. It shall be clean, dry, free from mould, blue wood, bark, large knots and discoloration.

4. Corner Angle Posts.

Eight corner angle posts shall be used of the full internal depth of the case, cut diagonally from a post 2 inches square. Square cut corner posts are not permissible.

5. Ends and Centre Divisions.

The case shall have two centre divisions, each centre division and each end consisting of two boards ; no board shall be less than 23 inches by three inches by 5/8 inch. If end boards of greater thickness than 5/8 inch are used, care should be taken to ensure that the internal length of each compartment be not less than the required 26 inches. Alternatively the centre division and ends may consist of one board not less than 23 inches by 8 inches by 5/8 inch.

6. Sides.

The side boards shall be of the full outside length of the case ; no side board shall be less than 3 inches wide, nor less than 3/8 inch thick.

The side boards must be so fixed that the top edge of the upper board, and the bottom edge of the lower board, will be level with the top and bottom edges, respectively, of the end boards.

7. Tops and Bottoms.

Top and bottom boards shall be not less than 4 inches wide, and not less than 3/8 inch thick.

The outer edges of the outside top boards and bottom boards, when nailed on, shall be flush with the outer sides of the side boards. The top and bottom boards shall be of the full outside length of the case, and be nailed into the end boards.

*8. Nails and Nailing.

The nails used shall be of sizes not less than the following :—

Not less than two nails shall be used in each end of each board, and an additional nail shall be used at each end of a board for every 3 inches or part of 3 inches by which the board exceeds 5 inches in width. This also applies to the nailing of the centre division boards. Each end of each side board shall be secured by at least 2 nails driven into the end boards, and at least 1 nail driven into the corner post.

In nailing top and bottom boards to centre division boards, care should be exercised to place the nails in rows with at least 3/8 inch space between the rows, to allow for the free working of a saw when the case is being divided.

PART II.—STANDARD CASE NO. 2.

1. Standard Case No. 2 shall be used to hold not more than 3 hnd. (360) hen eggs, weighing less than 18 lb. per 120, or 2½ hnd. (300) hen eggs, weighing 18 lb. or more per 120, or 2½ hnd. (300) duck eggs, weighing 18 lb. or more per 120.

The case shall hold 3 hnd. (360) hen eggs, weighing less than 18 lb. per 120, packed in three layers, each containing 10 rows of eggs with 12 eggs in each row ; or 2½ hnd. (300) hen eggs, weighing 18 lb. or more per 120 ; or 2½ hnd. (300) duck eggs, weighing 18 lb. or more per 120, packed in three layers, each containing 9 rows of eggs with 11 eggs in each row and one odd.

*It is recommended that cement-coated wire nails be used, and that, as far as possible, nails should be driven askew the grain of the wood.

2. Description.

This case which is equivalent to one-half of the Standard Case No. 1, shall be made in accordance with the following specification :—

Spacing between any two adjoining top, bottom, side and end boards nowhere to exceed 1 inch.

The internal dimensions and thicknesses of timber mentioned in this specification are minimum dimensions ; all timber thicknesses are actual, not nominal

3. Timber.

The wood shall be well seasoned, clean, dry and free from bark, wane and feather, large knots and discoloration.

4. Corner Angle Posts.

Four corner angle posts shall be used of the full internal depth of the case, cut diagonally from a post 2 inches square. Square cut corner posts are not permissible.

5. Ends.

The case shall have two boards in each end ; no board shall be less than 23 inches by 3 inches by 5/8 inch. If end boards of greater thickness than 5/8 inch are used, care should be taken to ensure that the internal length of each compartment be not less than the required 26 inches. Alternatively the ends may consist of one board not less than 23 inches by 8 inches by 5/8 inch.

6. Sides.

The side boards shall be of the full outside length of the case ; no side board shall be less than 3 inches wide nor less than 3/8" inch thick.

The side boards shall be so fixed that the top edge of the upper board, and the bottom edge of the lower board, will be level with the top and bottom edge, respectively, of the end boards.

7. Tops and Bottoms.

Top and bottom boards shall be not less than 4 inches wide, and not less than 3/8 inch thick.

The outer edges of the outside top boards and bottom boards when nailed on, shall be flush with the outer sides of the side boards. The top and bottom boards shall be of the full outside length of the case, and be nailed into the end boards.

*8. Nails and Nailing.

The nails used shall be of sizes not less than the following :—

Not less than two nails shall be used in each end of each board, and an additional nail shall be used at each end of a board for every 3 inches or part of 3 inches by which the board exceeds 5 inches in width. Each end of each side board shall be secured by at least 2 nails driven into the end boards, and at least 1 nail driven into the corner post.

*NOTE.—It is recommended that cement-coated wire nails be used, and that so far as possible, nails should be driven askew the grain of the wood.

PART III.—STANDARD CASE NO. 3

1. Standard Case No. 3 fitted with fillers, flats and pads of the sizes, descriptions and quality set out in the twelfth Schedule hereto shall be used to hold not more than 3 hnd. (360) eggs, weighing not more than 16 lb. per 120. Each compartment shall hold 180 eggs.

2. Description.

The case shall be made with two equal compartments, and in accordance with the following specification:—

The dimensions (other than internal) and thicknesses of timber mentioned in this specification, are minimum dimensions, all timber thicknesses are actual, not nominal.

3. Timber.

The wood shall be well seasoned, clean, dry and free from bark, wane and feather, large knots and discoloration.

4. Ends.

The ends shall be made of three boards fixed upright, one of which shall be placed exactly in the middle of the end and shall be not less than 4 inches wide. To the end boards shall be nailed cross-battens measuring not less than 12¼ inches by 2½ inches by ⁷/₁₆ inch thick, two on each end, fixed externally, one across the bottoms of the end boards and the other as close to the tops of the end boards as the construction of the lid permits. The battens shall be flush with the outer sides of the side boards.

5. Centre Division.

The centre division may consist of one or more boards and shall be 13½ inches deep and 12 ⁵/₈ inches wide, and not less than ⁷/₁₆ inch thick. The division shall be fixed in the centre of the case, secured by nails driven through the side and bottom boards.

6. Sides, Tops and Bottoms.

Each board shall be not less than ⁵/₁₆ inch thick, and not less than 3 inches in width.

7. Spacing.

The spacing between any two adjoining boards throughout the case shall nowhere exceed 5/8 inch. When spacing is provided between any two side boards or between any two centre boards it shall be arranged so as to prevent any of the flats working through and allowing two layers of eggs to come in contact.

*8. Nails and Nailing.

Each top and bottom board shall be secured by two nails driven into a cross-batten and one nail into an end board, and with two nails into the centre division board. An additional nail must be used at each end of a board for every 3 inches or part of 3 inches by which the board exceeds 5 inches in width.

The nails shall be not less than 1½ inches of 14 gauge, except in the case of the nails used for fixing the cross battens to the end boards of the package, which shall be not less than one inch and 15 gauge.

PART IV.—STANDARD CASE NO. 3 (LARGE).

1. Standard Case No. 3 (Large) fitted with fillers, flats and pads of the sizes, descriptions and quality set out in the twelfth Schedule hereto shall be used to hold not more than 3 hnd. (360) hen eggs and duck eggs, weighing not less than 17 lb. per 120, each compartment to take 180 eggs.

2. Description.

The case shall be made with two equal compartments, and in accordance with the following specification:—

The dimensions (other than internal) and the thicknesses of timber mentioned in this specification are minimum dimensions ; the timber thicknesses are actual, not nominal.

3. Timber.

The wood shall be well seasoned, clean, dry and free from bark, wane and feather, large knots and discoloration.

4. Ends.

Each end shall be not less than 13½ inches deep by 12 3/8 inches wide by 7/16 inch thick, and shall consist of three boards fixed upright, one of which shall be placed exactly in the middle of the end, and shall not be less than four inches wide. To the end boards shall be nailed cross-battens measuring not less than 13 inches by 2½ inches by 7/16 inch thick, two on each end, fixed externally one across the bottoms of the end boards and the other as close to the tops of the end boards as the construction of the lid permits. The battens shall be flush with the outer sides of the side boards.

It is recommended that cement-coated wire nails be used, and that, so far as possible, nails should be driven askew the grain of the wood.

5. Centre Division.

The centre division may consist of one or more boards, and shall be 13½ inches deep, 12 5/8 inches wide, and not less than 7/16 inch thick. The division shall be fixed in the centre of the case, secured by nails driven through the side and bottom boards.

6. Tops and Bottoms.

Each board shall be not less than 5/16 inch thick and not less than three inches in width.

7. Sides.

Each board shall be not less than 5/16 inch thick and not less than four inches in width.

8. Spacing.

The spacing between any two adjoining boards throughout the case shall nowhere exceed three-quarter inch. When spacing is provided between any two side boards, and between any two centre boards, it shall be arranged so as to prevent any of the flats working through and allowing two layers of eggs to come in contact.

*9. Nails and Nailing.

Each top and bottom board shall be secured by two nails driven into a cross-batten and one nail into an end board and with two nails into the centre division board. An additional nail shall be used at each end of a board for every three inches or part of three inches by which the board exceeds five inches in width.

The nails shall be not less than 1½ inches of 14 gauge, except in the case of the nails used for fixing the cross-batten to the end boards of the package, which shall be not less than one inch and 15 gauge.

SCHEDULE No. 4.

APPLIANCES AND REQUISITES FOR TESTING, GRADING, MARKING AND PACKING EGGS.

1. An adequate supply of grading-trays of suitable material so mounted on a wooden frame of a total depth of 3½ inches that the edges of the frame project ½ inch above the level of leather board top ; outside dimensions of top to be 26 inches long and 22 inches wide, top to be perforated with holes 1 ¼ inch in diameter to hold 120 eggs in 12 rows of 10 eggs each ; rows to be equally spaced, and to allow a clear margin of 1 inch between edge of outer row of perforations and inner side of frame.

2. One or more testing tables, one or more grading tables, and one or more packing tables conforming generally to the following specification, viz., each table to be 6 feet 6 inches long by 2 feet 3 inches broad, top of table to be constructed of 1-inch timber and mounted on three equally spaced frames or trestles of scantling 3 inches by 3 inches or on such other adequate supports as may be approved in any particular case ; alternatively, in lieu of packing tables, suitable trestles may be used.

*It is recommended that cement-coated wire nails be used, and that, so far as possible, nails should be driven askew the grain of the wood.

3. Weighing Machines.

(1) A weighing machine provided with arms or leaf large enough to accommodate a grading tray and capable of weighing accurately up to 30 lb.

(2) A single egg scales (counter scale type) to weigh up to 8 ozs. with the following weights:—2 oz., 1 oz., ½ oz., ¼ oz., 2 drams and 1 dram.

The weighing machine and scales must comply with the requirements of the Weights and Measures Acts, and any Regulations made thereunder by the Minister for Industry and Commerce.

4. One or more testing-lamps (oil, gas or electric), of at least 25 candle-power, fitted into an opaque, rectangular, or cylindrical shield or box having one or two circular openings, each of 1 inch diameter opposite the centre of the source of llumination. Where two openings are fitted, the openings shall be fitted in opposite sides of a rectangular box, and in the case of a cylindrical box, the openings shall be equally spaced. Each such opening shall be rimmed in such manner that when an egg is held against the opening, all the light coming through the opening shall pass through the egg ; asbestos-packing or similar material, non-conductive of heat, to be used in the rims.

5. Shears or blade for trimming straw.

6. Efficient appliances of metal or other approved material for stencilling or printing in black, or for branding on packages :—

(i) the identification letter and number assigned to the premises on which the eggs are packed ; and

PART A.—FILLERS.

1. Fillers conforming to the following specifications shall be used :—

2. Fillers shall be of pulp-board conforming to the following specification or of such other material as may be approved from time to time by the Minister.

(a) Material.

The fibre of the board shall be of clean wood pulp (mechanical, chemical or a combination of both) so treated as to comply in other respects with this specification.

(b) Weight.

The board shall be of substance equivalent to 330 grammes per square metre.

(c) Bursting Strain.

The bursting strain of the board when tested by the Mullen Paper Tester shall be not less than 40 lb. per square inch.

(d) Bulk.

(e) Colour.

White or cream.

(f) Mineral Matter.

The ash shall not exceed 3 per cent. on complete incineration.

(g) Water Absorption.

There shall not be any penetration of water through to the top side when representative samples measuring 2 inches by 1¾ inches are floated on the surface of distilled water in a glass vessel, at 60/65 degrees Fahrenheit, for 10 minutes.

3. The combined Filler-flat known as " Keyes Tray " may also be used.

PART B.—FLATS.

The flats used shall be of one of the following types :—

1. " Mapes " or

2. " Diamond " or

3. The combined filler flat known as the " Keyes Tray " or

4. Corrugated flats made in accordance with the following specification :—

(a) Material.

The fibrous constituents of the flat shall be mechanical or chemical wood pulp or a combination of both (not excluding waste paper of suitable quality) so treated as to comply in other respects with this specification.

(b) Weight.

The paper of the back shall be of substance equivalent to 115 grammes per square metre (47·1 Double Crown) 20 inches by 30 inches, 480 sheets to a ream. The paper of the front shall be of substance equivalent to 175 grammes per square metre (71·7 Double Crown) 20 inches by 30 inches, 480 sheets to a ream.

(c) Bursting Strain.

The bursting strain of the back and of the front of the flat when tested by the Mullen Paper Tester shall be not less than 7·7 lb. per square inch and 11·9 lb. per square inch for the respective substances specified in paragraph (b).

(d) Bulk.

Front paper ·010".

Back paper ·0065".

(e) Colour.

White or cream.

(f) Flutes.

Number of flutes per foot shall be 32. Height of flutes 3/16 inch. The flutes shall be regular in shape throughout the length of the flat and shall not be cut or dented.

(g) Water Absorption.

There shall not be any penetration of water through to the top side when representative samples measuring 2 inches by 2 inches cut from a corrugated flat having the back and front attached are floated on the surface of distilled water in a glass vessel at 60/65 degrees Fahrenheit for 10 minutes. Negresine to be used for this test.

(h) Adhesive.

Any reliable adhesive free from nitrogenous matter and odourless.

PART C.—PADS.

1. Pads shall be made in the style of corrugated flats and shall be of a minimum thickness of 3/16 inch at any point in its entire surface under a continuous load of 200 lb. for a period of not less than 15 minutes. Any adhesive substance used for fastening purposes shall be free from nitrogenous matter, odourless and such as will not be injurious to the keeping quality of eggs.

2. Pads of such other type or description as shall be approved by the Minister from time to time may also be used.
