STATUTORY RULES AND ORDERS. 1941. No. 369.

MINISTER FOR SUPPLIES (TRANSFER OF FUNCTIONS UNDER THE SCRAP IRON (CONTROL OF EXPORT) ACT, 1938), ORDER, 1941.

WHEREAS it is enacted by subsection (1) of Section 6 of the Ministers and Secretaries (Amendment) Act, 1939 (No. 36 of 1939), that it shall be lawful for the Government, whenever they so think proper, to do by order all or any of certain things mentioned in that subsection, and, amongst others, to transfer from any Minister having charge of a Department of State to the Minister having charge of any other Department of State any particular power, duty, or other function vested by or under any statute or otherwise in the said first-mentioned Minister, and to make all such adaptations of enactments as shall appear to the Government to be consequential on anything done by them under the said subsection :

AND WHEREAS certain powers and duties are conferred or imposed on the Minister for Industry and Commerce by the Scrap Iron (Control of Export) Act, 1938 (No. 6 of 1938) :

NOW, the Government, in exercise of the powers conferred on them by subsection (1) of section 6 of the Ministers and Secretaries (Amendment) Act, 1939 (No. 36 of 1939), and of every and any other power them in this behalf enabling, do hereby order as follows :—

1. This Order may be cited as the Minister for Supplies (Transfer of Functions under the Scrap Iron (Control of Export) Act, 1938 ) Order, 1941.

2. In this Order, the expression " the Act " means the Scrap Iron (Control of Export) Act, 1938 (No. 6 of 1938).

3. Each and every of the several powers conferred on the Minister for Industry and Commerce by the Act is hereby transferred to the Minister for Supplies.

4. Each and every of the several duties imposed on the Minister for Industry and Commerce by the Act is hereby transferred to the Minister for Supplies.

5. the Act shall be construed and have effect as if, in section 1 thereof, in lieu of the definition of the expression " the Minister " now contained therein, the said expression were defined as meaning the Minister for Supplies.
