PROTECTION OF ANIMALS (MARTS etc.) ORDER, 1984. | ||
I, AUSTIN DEASY, Minister for Agriculture, in exercise of the powers conferred on me by sections 28 and 48 of the Diseases of Animals Act, 1966 (No. 6 of 1966), as adapted by the Agriculture and Fisheries (Alteration of Name of Department and Title of Minister) Order, 1977 ( S.I. No. 31 of 1977 ), hereby make the following Order: 1. This Order may be cited as the Protection of Animals (Marts etc.) Order, 1984. 2. This Order applies to the following animals, namely, cattle, horses, sheep and swine. 3. (1) The person who either is the owner of or is for the time being in charge or control of any mart, market or fair or of any other place where any animals to which this Order applies are assembled prior to transport, shipment or exhibition shall, as regards any animals which are animals to which this Order applies and are for the time being at such mart, market, fair or other place— | ||
(a) provide or cause to be provided— | ||
(i) an adequate and accessible supply of potable water as often as is necessary to prevent their suffering from thirst, and | ||
(ii) in case having been assembled at such place, while awaiting transit, shipment or exhibition, such animals are kept there overnight and till 8 a.m. on any day, either before the time of their removal from such place or 10 a.m. on that day, whichever is the earlier, an accessible supply of suitable wholesome food, and | ||
(iii) in case the provision of bedding is required, a supply of suitable bedding which is adequate for them, and | ||
(b) ensure that those of the aforesaid animals as require to be milked are, while kept at such place, milked at appropriate intervals. | ||
(2) (a) The owner or person who is for the time being in charge of any animal which under paragraph (1) of this Article is required to be provided with a supply of food and which remains at the mart, market, fair or other place concerned after the hour of 10 a.m. on the day on which it is required so to be provided shall, at least once in the period of twelve hours beginning at the said hour and thereafter, for so long as the animal so remains, in each of any succeeding period of twelve hours beginning at 10 a.m., provide the animal with an accessible supply of suitable wholesome food. | ||
(b) A person who under paragraph (1) of this Article is required to provide an animal with a supply of food shall for the purposes of this paragraph not be regarded as being in charge of the animal. | ||
(c) Where the owner or person in charge of an animal is under subparagraph (a) of this paragraph required to provide the animal with a supply of food, then for so long as the animal remains at the mart, market, fair or other place concerned paragraph (1) of this Article, in so far as it relates to the supply of food, shall be construed as not applying in relation to the animal. 4. The omission by a person to comply with a requirement of Article 3 of this Order is hereby declared to be an offence. | ||

EXPLANATORY NOTE. | ||
This Order requires the owner or person in charge of a mart, market or other place where animals are assembled prior to transport or exhibition (a) to provide the animals with adequate drinking water (b) where the animals are kept overnight, to provide them with food in the morning (c) to provide bedding where necessary and (d) to arrange that animals which need milking are milked at appropriate intervals. Where an animal is kept on the premises for an extended period a supply of food must be provided at least once in every twelve hour period. |
