S.I. No. 512/2002 - European Communities (Control of Exports of Dual-Use Items) (Amendment) Regulations 2002

I, Mary Harney, Minister for Enterprise, Trade and Employment, in exercise of the powers conferred on me by section 3 of the European Communities Act 1972 (No. 27 of 1972), and for the purpose of giving effect to Council Regulation (EC) No. 1334/2000 of 22 June 20001 as amended by Council Regulation (EC) No. 2889/2000 of 22 December 20002 , Council Regulation (EC) No. 458/2001 of 6 March 20013 , Council Regulation (EC) No. 2432/2001 of 20 November 20014 , and Council Regulation (EC) No. 880/2002 of 27 May 20025 hereby make the following regulations:

1.         These Regulations may be cited as the European Communities (Control of Exports of Dual-Use Items)(Amendment) Regulations 2002.

2.         The European Communities (Control of Exports of Dual-Use Items) Regulations 2000 ( S.I. No. 317 of 2000 ) are amended in Regulation 2(1) by the substitution for the definition of “Council Regulation” of the following definition:

“ ‘Council Regulation’ means Council Regulation (EC) No. 1334/2000 of 22 June 20006 as amended by Council Regulation (EC) No. 2889/2000 of 22 December 20007 Council Regulation (EC) No. 458/2001 of 6 March 20018 , Council Regulation (EC) No. 2432/2001 of 20 November 20019 and Council Regulation (EC) No. 880/2002 of 27 May 200210 ;”.

EXPLANATORY NOTE

(This note is not part of the instrument and does not purport to be a legal interpretation).

The effect of this Order is to amend the European Communities (Control of Exports of Dual-Use Items) Regulations, 2000 ( S.I. No. 317 of 2000 ) which provides effective control of exports of dual-use items (items which may be used for both civil and military purposes) as provided for in Council Regulation (EC) No. 1334/2000 of 22 June, 2000 and to provide for penalties of the prohibition. This amendment arises as a consequence of several amendments made to Council Regulation (EC) No. 1334/2000.
