TRIBUNAL OF INQUIRY INTO CERTAIN PLANNING MATTERS AND PAYMENTS ACT 2004


AN ACT TO MAKE PROVISION IN RESPECT OF THE EXERCISE OF A PARTICULAR DISCRETION BY THE TRIBUNAL OF INQUIRY INTO CERTAIN PLANNING MATTERS AND PAYMENTS. [15th December, 2004]

BE IT ENACTED BY THE OIREACHTAS AS FOLLOWS:

Interpretation.

1.—(1) In this Act—

“Act” means the Tribunals of Inquiry (Evidence) Act 1921 ;

“relevant instruments” means the instrument mentioned in the definition of “Tribunal” in this section and each subsequent instrument under the Act that amends that instrument, namely the instruments of 15 July 1998, 24 October 2002, 7 July 2003 and 3 December 2004, respectively;

“terms of reference” means, in relation to the Tribunal, the terms of the resolutions passed by the Houses of the Oireachtas in respect of the Tribunal and referred to in the relevant instruments;

“Tribunal” means the tribunal appointed by instrument of 4 November 1997 made under the Act and known as the Tribunal of Inquiry into Certain Planning Matters and Payments.

(2) In this Act a reference to an enactment is a reference to that enactment as amended, extended or adapted by or under any subsequent enactment.

Exercise of a particular discretion.

2.—The Tribunal may exercise the discretion conferred on it by paragraph J(6) of its terms of reference.

Short title.

3.—This Act may be cited as the Tribunal of Inquiry into Certain Planning Matters and Payments Act 2004.
