I, RUAIRÍ QUINN, Minister for Education and Skills, in exercise of the powers conferred on me by section 2 (as amended by section 2 of the Teachers’ Superannuation (Amendment) Act 1990 (No. 28 of 1990)) of the Teachers’ Superannuation Act 1928 (No. 32 of 1928) (as adapted by the Education and Science (Alteration of Name of Department and Title of Minister) Order 2010 ( S.I. No. 184 of 2010 )), with the consent of the Minister for Finance, hereby make the following scheme: | ||
1. This Scheme may be cited as the Secondary, Community and Comprehensive School Teachers Pension (Amendment) (No. 2) Scheme 2011. | ||
2. The Secondary, Community and Comprehensive School Teachers Pension Scheme 2009 ( S.I. No. 435 of 2009 ) is amended by substituting for paragraph (3) of Article 4 the following: | ||
“(3) a person is eligible for membership in this Part if he or she was appointed before 1 August 1996 as a teacher in a secondary school at the age of not less than 21 years and was— | ||
(a) a registered secondary teacher serving in a full time post in a secondary school without an interruption in service and who was receiving remuneration paid by the Minister, | ||
(b) serving in a comprehensive school or a community school in a permanent teaching post without an interruption in service, or | ||
(c) serving in a comprehensive school or a community school in the post of chaplain without an interruption in service where his or her appointment occurred on or after 1 August 1990.”. | ||
The Minister for Finance consents to the making of the foregoing statutory instrument. | ||
