S.I. No. 377/2011 - Wildlife (Import and Export of Fauna and Flora) (Designation of Ports and Airports) (Amendment) Regulations 2011.

I, JIMMY DEENIHAN, T.D., Minister for Arts, Heritage and the Gaeltacht in exercise of the powers conferred on me by subsection (1A) (inserted by section 56(b) of the Wildlife (Amendment) Act 2000 (No. 38 of 2000)) of section 52 of the Wildlife Act 1976 (No. 39 of 1976), and subsection (1A) (inserted by section 57(b) of the Wildlife (Amendment) Act 2000 (No. 38 of 2000)) of section 53 of the Wildlife Act 1976 (No. 39 of 1976), and the Heritage (Transfer of Departmental Administration and Ministerial Functions) Order 2011 ( S.I. No. 192 of 2011 ), (as adapted by the Tourism, Culture and Sport (Alteration of Name of Department and Title of Minister) Order 2011 ( S.I. No. 220 of 2011 )) hereby make the following Regulations:

1. These Regulations may be cited as the Wildlife (Import and Export of Fauna and Flora) (Designation of Ports and Airports) (Amendment) Regulations 2011.

2. In these Regulations “Principal Regulations” means the Wildlife (Import and Export of Fauna and Flora) (Designation of Ports and Airports) Regulations 2001 ( S.I. No. 375 of 2001 ).

3. The Principal Regulations are amended—

(a) by inserting in Regulation 4 “Dundalk Port” after “Dublin Port”, and

(b) by deleting in Regulation 6, paragraph (1), “in respect of all species of plants and the flowers, roots, seeds or spores of such plants”, and

“8.In the case to which paragraph 1 of Article 12 of Council Regulation (EC) No 338/97 of 9 December 1996 on the protection of species of wild fauna and flora by regulating trade therein relates, the following places are intended to deal with live specimens (within the meaning of that Regulation):

(a) live animal specimens:

Dublin Airport

Shannon Airport

(b) live plant specimens:

Cork Airport

Dublin Airport

Shannon Airport

Cork Port

Dublin Port.”

EXPLANATORY NOTE

(This note is not part of the Instrument and does not purport to be a legal interpretation.)

These Regulations designate Ports and Airports of Entry and Exit for Trade with Third Countries in CITES (Convention on International Trade in Endangered Species of Wild Fauna and Flora) specimens.

1 As regards importation of live animals please note that for the purposes of various animal health requirements undertaken by the Department of Agriculture, Food and Marine, the Border Inspection Post (BIP) at Dublin Airport is restricted to the category of live animal “E” = Registered Equidae only and the BIP at Shannon Airport is restricted to the categories of live animal “E” = Registered Equidae and “U” = Ungulates only. Live animals of any other category must firstly be checked at another BIP in the EU prior to their introduction. Pet Animals that do not require a BIP check and comply with the terms of Regulation (EC) No 998/2003 are not affected by this restriction. Further information of BIP’s is available from the Department of Agriculture, Food and Marine.
