I, LEO VARADKAR, Minister for Transport, Tourism and Sport in exercise of the powers conferred on me by section 21 of the Road Traffic Act 2010 (No. 25 of 2010) as adapted by the Transport (Alteration of Name of Department and Title of Minister) Order 2011 ( S.I. No. 141 of 2011 ), hereby make the following regulations: | ||
1. These Regulations may be cited as the Road Traffic Act 2010 (Section 21) (Costs and Expenses) Regulations 2012. | ||
2. In these Regulations “Act of 2010” means Road Traffic Act 2010 (No. 25 of 2010). | ||
3. (1) The amount standing prescribed for the purposes of section 21(1) of the Act of 2010 is as follows: | ||
(a) in the case of analysis for the concentration of alcohol, €250; and | ||
(b) in the case of analysis for the presence of a drug or drugs, €350. | ||
(2) Payments received under section 21(1) of the Act of 2010 shall be paid into and disposed of for the benefit of the Exchequer in such manner as the Minister for Finance directs. | ||

These regulations provide for the maximum contribution towards the costs and expenses incurred by the Medical Bureau of Road Safety in the performance of its functions under section 21 of the Road Traffic Act 2010 of €250 in the case of analysis for the concentration of alcohol and €350 in the case of analysis for the presence of a drug or drugs. |
