S.I. No. 195/2015 - Private Security (Licensing and Standards) (Private Investigator) Regulations 2015.

The Private Security Authority, in exercise of the powers conferred on it by section 51 (as amended by section 15 of the Civil Law (Miscellaneous Provisions) Act 2011 (No. 23 of 2011)) of the Private Security Services Act 2004 (No.12 of 2004), with the consent of the Minister of Justice and Equality, hereby makes the following regulations: | ||
1. These Regulations may be cited as the Private Security (Licensing and Standards) (Private Investigator) Regulations 2015. | ||
2. These Regulations come into operation on 1st November 2015. | ||
3. In these Regulations— | ||
“appropriate fee” means the fee applicable to the category of licence concerned standing prescribed for the time being by regulations made under section 51 of the Private Security Services Act 2004 ; | ||
“licence” means a licence of a category prescribed under Regulation 4; | ||
4. Private investigator licence is prescribed as a category of licence which may be granted by the Authority to a private security employer or an independent contractor. | ||
5. An application for a licence prescribed by Regulation 4 shall be accompanied by the appropriate fee. | ||
6. PSA Licensing Requirements — Private Investigator (PSA 42: 2015) is prescribed as the standard to be observed in the provision of a security service by a private investigator licensee. | ||
7. The Private Security (Licensing and Standards) Regulations 2012 ( S.I. No.144 of 2012 ) are amended— | ||
(a) by the substitution of the following for Regulation 4 | ||
“(1) The following are prescribed as categories of licenses which may be granted by the Authority to a private security employer or an independent contractor— | ||
(a) door supervisor (licensed premises) licence, | ||
(b) door supervisor (event security), | ||
(c) installer of security equipment (access control) licence, | ||
(d) installer of security equipment (cctv) licence, | ||
(e) installer of security equipment (installation and maintenance of intruder alarm) licence, | ||
(f) maintainer of security equipment (intruder alarm) licence, | ||
(g) private investigator | ||
(h) security guard (alarm monitoring) licence, | ||
(i) security guard (cctv monitoring) licence, | ||
(j) security guard (event security) | ||
(k) security guard (static) licence.” | ||
(b) by the substitution of the following for Table 1 of Regulation 5(1) | ||

The Minister for Justice and Equality consents to the making of the foregoing Regulations. | ||

EXPLANATORY NOTE | ||

The Private Security (Licensing and Standards) (Private Investigator) Regulations 2015 provides for the Private Security Authority (PSA) to commence licensing, from 1 November 2015, private security employers and independent contractors who engage in the provision of private investigation services. | ||
These regulations also prescribe the standards which private investigators will need to comply with when providing such services, i.e PSA Licensing Requirements — Private Investigator (PSA 42:2015). |
