I, SIMON COVENEY, Minister for Agriculture, Food and the Marine, in exercise of the powers conferred on me by sections 3 and 14 of the Sea-Fisheries and Maritime Jurisdiction Act 2006 (No. 8 of 2006) and the Sea Fisheries, Foreshore and Dumping at Sea (Transfer of Departmental Administration and Ministerial Functions) Order 2007 ( S.I. No. 707 of 2007 ) (as adapted by the Agriculture, Fisheries and Food (Alteration of Name of Department and Title of Minister) Order 2011 ( S.I. No. 455 of 2011 )), for the purpose of giving further effect to Commission Regulation (EC) No 494/2002 of 19 March 20021 as amended by Commission Implementing Regulation (EU) 2015/1867 of 19 October 20152 , hereby make the following regulations: | ||
1. These Regulations may be cited as the Sea-Fisheries (Conservation and Rational Exploitation of Hake) (Amendment) Regulations 2016. | ||
2. The Sea Fisheries (Conservation and Rational Exploitation of Hake) Regulations 2006 ( S.I. No 179 of 2006 ) are amended by substituting in Regulation 2(1) for the definition of “Commission Regulation” the following- | ||
“‘Commission Regulation’ means Commission Regulation (EC) No 494/2002 of 19 March 2002 as amended by Commission Implementing Regulation (EU) 2015/1867 of 19 October 2015;”. | ||

These Regulations amend The Sea Fisheries (Conservation and Rational Exploitation of Hake) Regulations 2006 ( S.I. No 179 of 2006 ) which provide for technical control measures on Hake, as amended, to adopt the measures in Commission Implementing Regulation (EU) 2015/1897 of 21 October 2015 concerning unintended catches subject to the landing obligation requirement of the Common Fisheries Policy. | ||
