I, EAMON RYAN, Minister for the Environment, Climate and Communications, in exercise of the powers conferred on me by section 3 of the European Communities Act 1972 (No. 27 of 1972), and for the purpose of giving further effect to Article 7a (inserted by Article 5 of Directive 2009/30/EC of the European Parliament and of the Council of 23 April 20091 ) of Directive 98/70/EC of the European Parliament and of the Council of 13 October 19982 , as amended by Council Directive (EU) 2015/652 of 20 April 20153 , hereby make the following regulations: | ||
1. These Regulations may be cited as the European Union (Greenhouse Gas Emission Reductions, Calculation Methods and Reporting Requirements) (Amendment) Regulations 2020. | ||
2. The European Union (Greenhouse Gas Emission Reductions, Calculation Methods and Reporting Requirements) Regulations 2017 (S. I. No. 160 of 2017) are amended – | ||
(a) by inserting after Regulation 8 the following: | ||
“Maintenance of lifecycle greenhouse gas reductions | ||
8A. The reduction required to achieved by a supplier by 31 December 2020 in accordance with Regulation 8 shall be maintained by the supplier after that day in each subsequent year.”, | ||
and | ||
(b) in Regulation 17, by inserting after paragraph (5) the following: | ||
“(6) Where an application has been made by NORA under paragraph (1) and the High Court makes a compliance order under paragraph (4) but the non–compliance that is the subject of the application continues after the making of the order, NORA may make a further application under paragraph (1) in respect of that further non-compliance in that or any subsequent year.”. | ||
