S.I. No. 299/2024 - Animal Health and Welfare (Export) Regulations 2024

I, CHARLIE MCCONALOGUE, Minister for Agriculture, Food and the Marine, in exercise of the powers conferred on me by section 63 of the Animal Health and Welfare Act 2013 (No. 15 of 2013), hereby make the following regulations:

1. These Regulations may be cited as the Animal Health and Welfare (Export) Regulations 2024.

2. In these Regulations-

“Animal Identification and Movement system” means an established and continuing animal tracing system (including a database) referred to in section 63 of the Animal Health and Welfare Act 2013 or regulation 9 of the European Union (Animal Identification and Tracing) Regulations 2023 ( S.I. No 254 of 2023 );

“food business operator” means a food business operator approved in accordance with regulation 5 of the European Communities (Food and Feed Hygiene) Regulations 2019 ( S.I. No. 674 of 2019 ).

3. These Regulations apply to the type or breed of protected animals to which the collection of data applies.

4. The Minister may provide a food business operator access to data held on the Animal Identification and Movement system to verify the disease status and eligibility of an animal or animal product destined for the export market.

5. A food business operator shall not export to a third country an animal or animal product where the export conditions require the animal or animal product to meet certain criteria in relation to notifiable diseases, without first verifying that the animal or animal product is eligible for export on the Animal Identification and Movement system.

6. Regulation 5 is a penal provision to which section 63(5)(a) of the Animal Health and Welfare Act 2013 (No. 15 of 2013) applies.

7. The following Regulations are revoked-

(a) The Animal Health and Welfare (Export) Regulations 2018 ( S.I. No. 145 of 2018 ).
