S.I. No. 340/2024 - National Milk Agency (Conduct of Elections) (Amendment) Regulations 2024

I, CHARLIE MCCONALOGUE, Minister for Agriculture, Food and the Marine, in exercise of the powers conferred on me by section 20 of, and paragraph 5(5) (as amended by section 4 of the Milk (Regulation of Supply) (Amendment) Act 1996 (No. 41 of 1996)) of the Schedule to, the Milk (Regulation of Supply) Act, 1994 (No. 25 of 1994) (as adapted by the Agriculture, Fisheries and Food (Alteration of Name of Department and Title of Minister) Order 2011 ( S.I. No.455 of 2011 )), hereby make the following regulations:

1. These Regulations may be cited as the National Milk Agency (Conduct of Elections) (Amendment) Regulations 2024.

2. The National Milk Agency (Conduct of Elections) Regulations 1997 (S. I. No. 185 of 1997) are amended by:

(a) substituting for Regulation 4(2) (as amended by the National Milk Agency (Conduct of Elections) (Amendment) Regulations 2021 ( S.I. No. 373 of 2021 ), the following-

“(2) (a) The registered producers who have supplied raw milk for heat treatment for liquid consumption to one or more of the following-

(i) Tirlán Limited,

(ii) Lakeland Dairies Co-Operative Society Limited,

(iii) Aurivo Co-operative Society Limited,

(iv) Glenisk Limited

comprise a constituency and are entitled to elect 3 producer members to the National Milk Agency, and

(b) The registered producers who have supplied raw milk for heat treatment for liquid consumption to one or more of the following–

(i) The Village Dairy Limited,

(ii) Mossfield Organic Farm Ltd.,

(iii) Bainne Codladh Ltd.,

(iv) Arrabawn Co-operative Society Limited,

(v) Clona Dairy Products Society Limited,

(vi) Dairygold Co-operative Society Limited (as agent for Tirlán Limited),

(vii) Dawn Dairies Limited (Kerry Creameries Limited T/A Kerry Agribusiness – Dairies,

(viii) Lee Strand Co-operative Creamery Limited,

(ix) North Cork Co-operative Creameries Limited,

(x) Centenary Thurles Co-operative Society Limited (Thurles Fresh Milk Limited)

comprise a constituency and are entitled to elect 2 producer members to the National Milk Agency.”,

(b) the amendment of Regulation 13 by the substitution of “the closing date for receipt of nomination papers” for “the nomination day”,

(c) the amendment of Regulation 20(a) by the substitution of “the place and times for the counting of votes, the date (“the ballot return day”) by which completed ballot papers must be received by the returning officer;” for “the place and times for the counting of votes;” and

(d) the amendment of Regulation 28(1) by the substitution of “On the working day next following the ballot return day, or such other day as may be approved by the returning officer” for “At the hour of 2.00 p.m. on the day next following the day on which the return of all ballot papers issued at an election to the returning officer is completed”.

The purpose of these Regulations is to establish constituencies for the election of producer members to the National Milk Agency and to further provide for the ballot return day, and the day for opening ballot boxes.
