S.I. No. 118/2026 - Education and Youth (Delegation of Ministerial Functions) Order 2026

Notice of the making of this Statutory Instrument was published in

“Iris Oifigiúil” of 6th March, 2026.

The Government, on the request of the Minister for Education and Youth and in exercise of the powers conferred on them by section 2 (1) of the Ministers and Secretaries (Amendment) (No. 2) Act 1977 (No. 28 of 1977), hereby order as follows:

1. This Order may be cited as the Education and Youth (Delegation of Ministerial Functions) Order 2026.

2. The powers and duties of the Minister for Education and Youth conferred on her by or under the provisions of the enactments specified in the Schedule are delegated to Michael Moynihan, Minister of State at the Department of Education and Youth.

SCHEDULE

Section 7 (1)(a) of the Education Act 1998 (No. 51 of 1998), in so far as that provision relates to persons with a disability or other special educational needs (both within the meaning of section 2(1) of that Act)

Section 7 (1)(c)(ii) of the Education Act 1998 , in so far as that provision relates to transport services

Subsections (3) and (4) of section 7 of the Education Act 1998 , in so far as those provisions relate to the performance of the other functions under that Act delegated by this Order

Section 33 (i) and (j)(iv) of the Education Act 1998 , in so far as those provisions relate to persons with a disability or other special educational needs (both within the meaning of section 2(1) of that Act)

Section 37A of the Education Act 1998

Sections 21 , 22 and 28 of, and Schedule 1 to, the Education for Persons with Special Educational Needs Act 2004 (No. 30 of 2004)
