THE LIGHTING OF VEHICLES REGULATIONS, 1934.

The Minister for Local Government and Public Health in exercise of the powers conferred on him by Section 163 of the Road Traffic Act, 1933 , and in exercise of every other power enabling him in this behalf, hereby makes the following regulations, that is to say :—

1 Short Title

1. These regulations may be referred to as "The Lighting of Vehicles Regulations, 1934."

2 Interpretation

2. The Interpretation Act, 1923 , shall apply to the interpretation of these regulations in the same manner in which it applies to the interpretation of an Act of the Oireachtas.

3 Definitions

3. In these regulations the following expressions have the meanings hereby assigned to them respectively :—

" The Act " means the Road Traffic Act, 1933 ;

" Right, " " Left, " " Front " and " Rear, " mean respectively right, left, front and rear, when facing the direction in which the vehicle travels ;

"Lamp" does not include :

(a) any light used for the internal illumination of a vehicle, or

(b) any light used to illuminate a number, plate, taximeter or any device for giving signals to overtaking traffic, or

(c) in the case of a public service vehicle any light used for the purpose of illuminating a board, plate, or device indicating the route or destination of the vehicle ;

" Obligatory " when used in relation to a lamp which is carried on a vehicle means that the lamp is so carried in compliance with an express provision of the Act ;

" Front lamp " means a lamp showing light to the front of the vehicle on which it is carried ;

" Rear lamp " means a lamp showing light to the rear of the vehicle on which it is carried ;

In determining, for the purposes of these regulations, the position of any lamp from which light is emitted through one or more apertures in an opaque casing, such lamp shall be deemed to consist only of the rim or rims of such aperture or apertures ;

" The projection of a vehicle " in a specified direction from a specified point means the distance (measured in such direction) between the two parallel vertical planes which are perpendicular to such direction, one passing through such specified point and one passing through the extreme point of the portion of the vehicle, or its equipment, or its load which projects furthest in such direction ;

" The direction of the light " of a lamp means the direction in relation to the vehicle on which the lamp is fitted, in which the light is projected from such lamp ;

" To alter the direction of the light " from a lamp includes everyalteration of such direction whether effected by a rotational or other movement of the lamp or any part thereof or by a deflection of the light projected therefrom.

4 Application of regulations

4. The requirements of these regulations in relation to the lamps fitted or to be fitted on a vehicle or to the use of such lamps shall apply only while such vehicle is on a road.

5 Vehicles in parking places

5. Any vehicle which is stationary in a place which is a parking place within the meaning of the Act shall be exempt from the operation of any provision of the Act or of these regulations requiring the carrying of any lamp upon such vehicle.

6 Farm vehicles

6. A vehicle which is not a mechanically-propelled vehicle and which is engaged in the internal operations of a farm, and while so engaged is carrying a load which consists wholly or to a substantial extent of agricultural produce of an inflammable nature shall be exempt for the time being from every provision of the Act and of these regulations which require the carrying by such vehicles of any lamp.

7 Obligatory front lamps where two are required

7. Where there are two obligatory front lamps on a mechanically-propelled vehicle the following provisions shall have effect in relation to such lamps, that is to say :—

(1) They shall be as nearly as possible of the same power.

(2) They shall be carried fixed as nearly as possible at the same height from the ground.

(3) One such lamp shall be fixed to the right of the vehicle or its load in such a position that the projection of the vehicle to the right from the point of the lamp which is furthest to the right is not greater than 12 inches, and the other such lamp shall be fixed to the left of the vehicle or its load in such a position that the projection of the vehicle to the left from the point of the lamp which is furthest to the left is not greater than 12 inches.

(4) Each such lamp shall be so constructed and fitted to the vehicle that, while the vehicle is in motion, it is not possible to alter the direction of the light from such lamp.

8 Obligatory front lamps on bicycles

8. On any bicycle the obligatory front lamp shall be carried fixed in front of the steering column or front fork.

9 Obligatory front lamps on non-mechanically-propelled vehicles other than bicycles

9. On any vehicle which is not a mechanically-propelled vehicle, nor a vehicle drawn by a mechanically-propelled vehicle, nor a bicycle, the obligatory front lamp shall be carried fixed to the right of such vehicle or its load, in such a position that the projection of the vehicle to the right from the point of such lamp which is furthest to the right is not greater than 12 inches, and such lamp shall be so constructed and fitted that, while the vehicle is in motion, it is not possible to alter the direction of the light from such lamp.

10 Obligatory rear lamps

10. Every obligatory rear lamp shall be fixed to the vehicle or its load in such a position that the projection of the vehicle to the rear from the point of the lamp which is furthest to the rear does not exceed six feet.

11 Rear lamps

11.—(1) The following provisions shall apply to every rear lamp on a vehicle or its load whether obligatory or not obligatory, that is to say :—

(a) The lamp shall show a red light.

(b) The lamp shall not be fixed

(i) if the vehicle has one axle only to the left of the centre of such axle, and

(ii) if the vehicle has more than one axle to the left of the centre of the rear axle, and

(iii) if the vehicle is a bicycle to the left of the centre line of the tyres.

(2) If shall not be lawful to carry a rear lamp on a vehicle unless such lamp complies with the provisions of this Article.

12 Red lamps

12. It shall not be lawful to carry in or on any vehicle a lamp showing a red light unless either :—

(a) such lamp is invisible to persons outside such vehicle, or

(b) such lamp is a rear lamp which complies with the provisions of these regulations in relation to rear lamps.

13 Green lights

13. It shall not be lawful after the 1st day of January, 1935, to carry in or on any vehicle a green light unless such light is invisible to persons outside the vehicle, whether such light is or is not a lamp within the meaning of these regulations.

14 Red reflectors

14.—(1) Every red reflector carried on any vehicle in pursuance of the provisions of the Act shall comply in all respects with the following conditions :—

(a) The reflector shall be so constructed that, if placed 100 feet away from and squarely facing a source of light throwing a beam of white light of 2,000 candle power in the direction of the reflector, the reflector when turned in any direction through an angle not exceeding 22½ degrees, shall reflect a beam of red light of not less than one-thousandth of a candle power in any direction making an angle not greater than 3 degrees with an imaginary line connecting the reflector and the source of light aforesaid.

The aperture (or, if more than one, each aperture) of the frame of the reflector if circular, shall have a diameter of not less than 1¼ inches, and if not circular shall be of such a size that a circle of 1¼ inches diameter may be inscribed therein.

(2) Every red reflector carried on any vehicle in pursuance of the provisions of the Act shall be fixed to the vehicle in a position which complies in all respects with the following provisions :—

(a) The reflector shall be vertical and facing squarely to the rear.

(b) The centre of the aperture (or, if more than one, each aperture) shall be not less than 15 inches above the ground.

(c) No part of the vehicle shall project more than 20 inches to the rear of the vertical plane passing through the reflector from right to left.

(d) The centre of the aperture (or, if there are more than one, of each aperture) shall not be,

(i) if the vehicle has one axle only, to the left of the centre of such axle, and

(ii) if the vehicle has more than one axle, to the left of the centre of the rear axle, and

(iii) if the vehicle is a bicycle to the left of the centre line of the tyres.

(3) It shall not be lawful to carry in or on any vehicle a red reflector unless either such reflector is invisible to persons outside such vehicle or such reflector is fixed to the vehicle in a position which complies in all respects with the provisions made by the foregoing sub-article.

15 Change of direction of light from lamp

15.—(1) In this section the expression " deflectable front lamp " means a front lamp so constructed and fitted to the vehicle that, while the vehicle is in motion, it is possible to alter the direction of the light from such lamp in either or both of the following ways, but not otherwise, that is to say :—

(a) by an automatic deflection of the beam of light emitted from the lamp, which comes into action with and conforms to the rotation of the front wheels of the vehicle during the action of steering ;

(b) by a deflection of such beam downwards or to the left or both which can be effected by the driver when he so desires, for the purpose of avoiding dazzle.

(2) It shall not be lawful while a vehicle is in motion to alter the direction of the light from any lamp fitted to the vehicle unless such lamp is a deflectable front lamp.

(3) The number of deflectable front lamps fitted to a vehicle shall not exceed two.

(4) Every deflectable front lamp shall be fixed in such a position that the lowest portion of the lamp is not more than 3 feet 3 inches above the ground level.
