I, THOMAS F. O'HIGGINS, Minister for Industry and Commerce, in exercise of the powers conferred on me by Article 31 of the Emergency Powers Order, 1939 (S. R. & O. No. 224 of 1939), as amended by the Emergency Powers (No. 173) Order, 1942 (S. R. & O. No. 166 of 1942,) (which Orders are continued in force by the Supplies and Services (Temporary Provisions) Act, 1946 (No. 22 of 1946), as amended by the Supplies and Services (Temporary Provisions) Act, 1946 (Continuance and Amendment) Act, 1950 (No. 34 of 1950)) and of every and any other power me in this behalf enabling, hereby order as follows :— 1. This Order may be cited as the Imported Timber (Maximum Prices) (No. 18) Order, 1951. 2.—(1) In this Order— | |||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
the expression " the Minister " means the Minister for Industry and Commerce ; | |||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
the expressions " deep cut " and " flat cut " shall have the meanings customarily attached to them in the course of trade in timber. | |||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
(2) References in this Order to selling shall be construed as including references to agreeing or offering to sell or to inviting an offer to buy. 3.—(1) No person shall sell imported Whitewood of a kind and description mentioned in Part I of the Schedule hereto at a price in excess of a price calculated at the appropriate rate set out in column (3) for any dimensions set out in column (2) of the said Part1. | |||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
(2) No person shall sell imported Redwood of a kind and description mentioned in Part I of the Schedule hereto at a price in excess of a price calculated at the appropriate rate set out in column (4) for any dimensions set out in column (2) of the said Part 1. 4. Where imported Whitewood or Redwood has been deep cut or flat cut after importation the Vendor may add to the appropriate maximum price calculated according to the terms of the preceding paragraphs a charge not exceeding :— | |||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
(1) in the case of deep cuts a charge calculated at the appropriate rate set out in column (3) of Part 11 of the Schedule hereto for any width set out in column (2) of the said Part 11 ; | |||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
(2) In the case of flat cuts a charge calculated at the rate set out in column (3) of Part 111 of the Schedule hereto for the thickness set out in column (2) of the said Part 111. 5. No person shall sell any imported Whitewood or Redwood unless such timber is so described on every quotation, estimate, invoice or other document used in connection with the sale. Where the timber has been deep cut or flat cut after importation the charges, if any, for such cutting shall be stated in such documents. 6. Where imported Whitewood or Redwood is sold and is delivered at any place not more than five miles from the vendor's premises, no charge shall be made for the delivery. 7. Where imported Whitewood or Redwood is sold by a timber merchant not being a merchant who obtains his supplies by direct importation, the appropriate price may be increased by an amount not exceeding the cost of transport at the cheapest rate available borne by such timber merchant. 8. Where Whitewood or Redwood is imported through any of the ports of Galway, Sligo, Ballina, Westport, Kilrush, Bunbeg and Letterkenny an addition not exceeding thirty shillings per standard of two hundred and seventy cubic feet may be made to the prices set out in Part 1 of the Schedule hereto. 9. Where a direction is given by the Minister in respect of any particular person or group of persons or in respect of any particular imported Whitewood or Redwood, the provisions of this Order shall, if and insofar as they are inconsistent with such direction, have effect subject to such direction. 10. Where imported Whitewood or Redwood is sold and the quantity of the timber is 10 cubic feet or less, an addition not exceeding 10 per cent. may be made in calculating the proper maximum price. 11. The Home-Grown Timber (Maximum Prices) Order, 1949 ( S.I. No. 120 of 1949 ) shall not apply to imported Whitewood or Redwood. 12. The Imported Timber (Maximum Prices) (No. 10) Order, 1947 ( S. R. & O. No. 405 of 1947 ) and the Imported Timber (Maximum Prices) (No. 11) Order, 1947 ( S. R. & O. No. 406 of 1947 ) and the Imported Timber (Maximum Prices) (No. 17) Order 1951 ( S.I.
