INSTITUTIONAL ASSISTANCE REGULATIONS, 1954.

The Minister for Health, in exercise of the powers conferred on him by the Health Acts, 1947 and 1953, hereby makes the following Regulations :—

1 Citation.

1. These Regulations may be cited as the Institutional Assistance Regulations, 1954.

2 Definitions.

2. In these Regulations—

" the Act " means the Health Act, 1953 (No. 26 of 1953) ;

" the Minister " means the Minister for Health.

3 Commencement.

3. These Regulations shall come into operation on 1st day of August, 1954.

4 Manner of making assistance available.

4. Institutional assistance under section 54 of the act may be made available by a health authority—

(a) by providing such assistance in a county home or other similar institution maintained by that authority, or

(b) by making arrangements under section 10 of the act for the provision of such assistance in other institutions.

5 Limitation on application of remaining Articles.

5. Articles 6 to 11 of these Regulations shall apply only to institutional assistance given in a county home or similar institution maintained by a health authority and the references in the said Articles to an institution shall be construed accordingly.

6 Admissions to county homes and similar institutions.

6.—(1) A person shall not be admitted to an institution for institutional assistance otherwise than by the matron, head nurse or other authorised officer of the institution—

(a) on an order of admission given within the preceding six days by the health authority ;

(b) on an order of admission given within the preceding six days by a person who is an authorised person for the purposes of Chapter II of Part III of the General Medical Services Regulations, 1954 ;

(c) on the order of the officer in charge of a hospital maintained by a health authority (accompanied by a certificate of a medical officer of the hospital) where the person is transferred from such hospital to the institution ;

(d) in pursuance of an agreement with another health authority ;

(e) on the direction of the medical officer of the institution or in his absence, without such direction, in any case of urgent necessity, or in pursuance of any enactment.

(2) Every order of admission shall specify the name and address of the person to be admitted, his age, religion and calling, and the name and address of his nearest known relative or friend.

(3) Where a person has been admitted for institutional assistance to an institution otherwise than by an order of admission given by the health authority, the admission of such person shall be notified forthwith to the health authority who shall decide on the propriety of permitting the person to continue in the institution or otherwise, and order accordingly.

(4) The provisions of sub-articles (1) to (3) of this Article shall not apply in the case of a person who is re-admitted to the institution after having left it temporarily, with the consent of the matron, head nurse or other authorised officer of the institution, given in accordance with any directions of the health authority.

7 Accommodation, medical examination and treatment.

7.—(1) The health authority shall assign to every person receiving institutional assistance, accommodation suitable to his condition.

(2) The health authority may as a condition of the giving of institutional assistance to any person in an institution require that he shall be examined by a medical officer of the institution at such times as may be considered necessary.

(3) If, at any time, a person receiving institutional assistance is suffering from physical or mental disability, the health authority shall, where necessary, arrange for the provision of institutional services for such person.

8 Clothing, etc.

8.—(1) Where any clothes or other articles received from a person to whom institutional assistance is given are not retained by him for use whilst he is receiving such assistance, they shall be labelled and placed in a suitable place for restoration to him on his leaving the institution and a record thereof shall be kept.

(2) If the clothes of a person who has received institutional assistance are not restored to him on his leaving the institution, the health authority shall provide him with suitable and sufficient clothing.

9 Visiting.

9. The health authority may fix certain days on which persons receiving institutional assistance may, with the permission of the matron, head nurse or other authorised officer of the institution, be visited by relatives and friends and may prescribe the hours during which such visits may take place.

10 Notice of intention to leave an institution.

10. A person receiving institutional assistance who intends to leave the institution shall give reasonable notice of his intention to the matron, head nurse or other appropriate officer of the institution.

11 Diets.

11. The diets of persons receiving institutional assistance shall be such as may be approved of or directed by the Minister or, in the case of a sick person receiving such assistance, such diet as the medical officer of the institution may direct in writing to be necessary.

12 Contributions.

12. Where a person while receiving institutional assistance is in receipt of an income in money exceeding ten shillings a week, he may be required, out of so much of the income as exceeds ten shillings a week, to contribute such amount as the health authority consider appropriate towards the cost incurred by the health authority in providing him with institutional assistance.
