I, JOSEPH BRENNAN, Minister for Labour, in exercise of the powers conferred on me by sections 11 , 15 , 17 , 18 and 127 of the Mines and Quarries Act, 1965 (No. 7 of 1965) and the Labour (Transfer of Departmental Administration and Ministerial Functions) Order, 1966, ( S.I. No. 164 of 1966 ), and after due compliance with the provisions of the Second Schedule to that Act, hereby make the following regulations:

PART I. Preliminary and General.

1 Short title.

1. These Regulations may be cited as the Mines (Managers and Officials) Regulations, 1970.

2 Commencement.

2. These Regulations shall come into operation on the 1st day of June, 1970.

3 Interpretation.

3. In these Regulations—

"the Act" means the Mines and Quarries Act, 1965 ;

"deputy" means a person appointed as a deputy (shift boss) for the purposes of Regulation 13;

"deputy's certificate" means a certificate granted in respect of a person regarded by an inspector as suitable for appointment as a deputy (shift boss) under Regulation 31;

"inspector" means an inspector appointed under section 130 of the Act;

"mine" means a mine to which the Act applies;

"Minister" means the Minister for Labour;

"owner" when used in relation to any mine means the person for the time being entitled to work it;

"pre-shift inspection" has the meaning assigned thereto in Regulation 16;

"working area" means all the working places in a mine which are below ground and in which workmen in the charge of a deputy (shift boss) are deployed by him for the performance of their duties and includes any immediate means of access or egress to or from such places.

4 Application.

4. These Regulations shall apply to every mine.

5 Power of exemption.

5. The Minister or any inspector may, by notice served on the owner, exempt the mine from the application of any provision of these Regulations if he is satisfied that the safety of persons employed at the mine will not be prejudiced in consequence of the granting of the exemption.

PART II. Managers.

6 Appointment and qualifications of managers.

6. For the purposes of Section 15 of the Act the following age, qualifications and conditions, in relation to a person to be appointed to be the manager of a mine, are hereby prescribed;

(a) at least twenty-six years,

(b) the holding of, either

(i) a qualification specified in the First Schedule to these Regulations, or

(ii) any other qualification of equivalent standard acceptable to the Minister,

(c) the person shall have had not less than three years, appropriate practical experience in one or more mines,

(d) the person shall not be suffering from a physical disability which is such that by reason thereof he is unable to discharge satisfactorily the duties of manager of a mine,

respectively.

7 Miscellaneous duties of managers.

7. The manager of every mine shall ensure that a sufficient supply of suitable materials and appliances is at all times readily available for ensuring compliance with all requirements imposed by or under the Act and the safety of the mine and of persons employed therein.

8. The manager of every mine shall give attention to and cause to be carefully investigated any representation or complaint made to him by or on behalf of persons employed thereat about any matter affecting the safety or health of such persons.

9 ..

9. The manager of every mine shall ensure that a suitable system is established and maintained to check-in persons going below ground and to check out persons who have returned to the surface.

10. The manager of every mine shall make and maintain arrangements for supervising all matters arising in connection with the carrying out of the duties of the deputies (shift bosses) of the mine and other officials having charge of operations carried on at the mine.

PART III. Underground Officials superior to the Deputies (Shift Bosses).

11 ..

11. No person shall be qualified to be appointed under section 18 (1) of the Act, or to be, an underground official superior to the deputies (shift bosses) but inferior to the manager unless—

(a) he is the holder of, either—

(i) a qualification specified in the First Schedule to these Regulations, or,

(ii) any other qualification of equivalent standard acceptable to the Minister, or

(b) he is the holder of a deputy's certificate, has attained the age of twenty-two years and has had not less than one year's experience as a deputy (shift boss).

12 ..

12. (1) Without prejudice to the generalities of the provisions of the Act, where necessary, the manager may appoint suitably qualified underground officials superior to the deputies (shift bosses) but inferior to the manager to have the management and control of the operations below ground consisting of all operations below ground and any plant or machinery installed on the surface for the purpose of raising or lowering men or materials or for the purpose of producing ventilation in the mine. Nothing in this paragraph shall be construed as divesting the manager of any power, or relieving him from any duty or liability, conferred or imposed on him by or by virtue of the Act.

(2) Every such underground official superior to the deputies (shift bosses) but inferior to the manager shall to the extent of his jurisdiction have the duty of securing compliance with all requirements imposed by or under the Act and the safe performance of all operations.

(3) An underground official appointed under this regulation shall—

(a) during each shift of his confer with the deputy (shift boss) in charge of the workmen in each working area and with each other official then performing duties in or responsible for any part of the mine below ground being areas or parts to which his jurisdiction extends,

(b) at the end of each shift of his give to any person succeeding to any of his duties all information he has obtained which is relevant to safety, and

(c) as soon as practicable after the end of each shift of his examine and counter-sign any report made by such a deputy (shift boss) in relation to that shift by virtue of Regulation 28.

PART IV. Deputies (Shift Bosses).

13 General duties of deputies or shift bosses.

13. (1) In every mine, competent persons appointed as deputies (shift bosses) shall each during his shift:—

(a) have the immediate charge of the workmen for the time being assigned to him, and of all operations carried on by them; and

(b) make such inspections and carry out such duties with regard to the presence of gas, ventilation, support of roof and sides and general safety (including the health of persons working in that part of the mine where the afore-mentioned operations are being carried on by them) as are required by the Act, or by regulations (including these Regulations).

(2) No duty shall be assigned to a deputy (shift boss) if the performance of that duty would prevent the deputy (shift boss) carrying out the duties specified in paragraph (1) of this regulation in a thorough manner, and an inspector may serve a notice on the manager requiring that such a duty shall not be so assigned, if he is of opinion that performance thereof would be likely to prevent the deputy (shift boss) so carrying out those duties.

(3) No deputy (shift boss) shall at any time perform any duty himself or allow any workman in his charge to do any work, if so doing would prevent or delay the due carrying out of any duty or work necessary for securing the safety or health of workmen employed at the mine.

14 ..

14. (1) The manager of every mine shall ensure that a correct record is made during every shift denoting the working places in the working area within which the workmen assigned to each deputy (shift boss) are employed on the shift. All such records shall be kept readily available at the mine.

(2) The manager shall ensure that no such working area is of a size which may prevent the deputy (shift boss) assigned thereto making the pre-shift inspection referred to in Regulation 16 within a period of two hours if he is not interrupted in so doing.

15 ..

15. (1) It shall be the duty of the manager to secure that a deputy (shift boss) is assigned to each working area for each shift during which any workman is to go into any working place in that area.

(2) Paragraph (1) of this regulation shall not apply where no persons other than pump-minders, mechanics, electricians or persons performing duties of a specialised nature are working below ground, but the manager shall make suitable arrangements to ensure that the safety of the persons so working is in no way prejudiced.

(3) The arrangements required to be made by the manager by paragraph (2) of this regulation shall be in accordance with at least one of the following provisions, that is to say, any of the persons working below ground shall be:

(a) accompanied at all times during the shift by a competent workman appointed by the manager; or

(b) visited at intervals not exceeding two hours during the shift by deputy (shift boss) or a competent person appointed by the manager; or

(c) in telephonic communication, at least once in every two hours during the shift, with a competent person appointed by the manager on the surface of the mine.

16 Pre-shift inspection.

16. (1) Within the period of two hours immediately before the commencement of work on any shift during which the workmen assigned to him for the shift will enter the working area in which mining operations are to be carried out during the shift, the deputy (shift boss) in charge of the workmen in that working area for that shift or for the last preceding shift shall himself ascertain by an inspection of every part of the working area which is required to be ventilated the condition of every such part as regards the presence of gas (other than flammable gas which is known not to be present in the mine), ventilation, state of roof and sides and general safety (hereinafter referred to as the pre-shift inspection):

Provided that during any period in which workmen are continously in the working area since the last preceding pre-shift inspection it shall be sufficient for such inspections to be made at intervals not exceeding eight hours:

Provided also that in the case of a mine, other than a mine of coal or other stratified mineral, where, in the opinion of the manager of that mine, the working arrangements of the mine are such that it would not be practicable to require the deputy (shift boss) on that shift to make the pre-shift inspection in each working place in the working area, in lieu of making the pre-shift inspection the deputy (shift boss) shall authorise such competent persons as are sufficient to likewise inspect every working place before the commencement during the shift of any work at the place.

(2) Every deputy (shift boss) making a pre-shift inspection in a mine to which section 63 of the Act applies shall have with him a locked flame safety-lamp and a locked electric safety-lamp or a locked safety-lamp combining those two, being in every case a lamp for the time being approved by the Minister for the purpose of deputies' (shift bosses') inspections, and he shall not use any other lamp during his inspection.

17 Meeting stations

17. (1) The manager shall fix a station or stations at the mine (hereinafter referred to as the meeting station) and shall ensure that notices indicating the position of every meeting station are kept posted at such suitable places and in such characters as to be easily seen.

(2) An inspector may, if he is of opinion that the position of any meeting station does not provide adequately for the safety of the workmen, serve on the manager a notice requiring him to alter the position thereof.

18 ..

18. (1) No workman shall pass beyond the meeting station of or enter any working area unless he is instructed to do so by the deputy (shift boss) to whom he is assigned or he does so in pursuance of an arrangement made by the manager.

(2) The deputy (shift boss) or a competent person or persons authorised by him under regulation 16 shall not instruct any workman to enter a working place unless he is satisfied that, having regard to any instruction he gives to that workman relating to his safety the workman can safely enter that working place.

19 Inspections during shifts.

19. (1) Every deputy (shift boss) to whom workmen are assigned for any shift shall at least twice during that shift inspect every part of his working area which is required to be ventilated to ascertain the condition thereof as regards the presence of gas (other than flammable gas which is known not to be present in the mine) ventilation, state of roof and sides and general safety in such manner that no working place shall remain uninspected for more than four hours.

(2) Nothing in paragraph (1) of this regulation shall require the inspection of a development working place which the manager has caused to be marked with a notice to the effect that work therein is for the time being discontinued.

(3) Regulation 16 (2) shall apply to an inspection under this regulation as it applies to a pre-shift inspection.

20 Miscellaneous duties of deputies.

20. A deputy (shift boss) to whom workmen are assigned for any shift shall ensure that any working place which is for the time being dangerous by reason of the presence of gas or from any other cause is so fenced off at each approach as to prevent any person from accidentally entering it and that each such fence is clearly marked with a danger sign provided by the owner of the mine.

21 ..

21. Every deputy (shift boss) to whom workmen are assigned for any shift shall:—

(a) record the names of the workmen under his charge during that shift; and

(b) take all reasonable steps to ensure that such workmen understand and carry out any duties which fall to be performed by them in order to secure compliance with all requirements imposed by or under the Act or to secure the safety or health of any person employed at the mine.

22 ..

22. Every deputy (shift boss) to whom workmen are assigned shall take all reasonable steps to ensure that—

(a) all machinery, apparatus and other equipment in use in the working area is properly maintained, and

(b) no machinery, apparatus or equipment which is found by or reported to him to be in an unsafe condition is used while in that condition.

23 ..

23. A deputy (shift boss) to whom workmen are assigned shall, where not less than two ways of egress from the working area or from any working place therein are required under section 32 of the Act, forthwith make himself acquainted with two such ways from the working area and from any such working place therein and shall thereafter travel along the whole of each of them once at least a month.

24 ..

24. (1) A deputy (shift boss) to whom workmen are assigned for any shift shall not leave the working area while workmen remain therein unless he has committed the charge of those workmen to a competent person or persons who shall during the absence of the deputy (shift boss) perform the functions of the deputy (shift boss).

(2) Nothing in paragraph (1) of this regulation shall be construed as relieving the deputy (shift boss) from any responsibility imposed on him by or under the Act or in particular as relieving the deputy (shift boss) from himself making the inspections and reports required by these Regulations.

25 Deputies' duties on conclusion of shift.

25. Every deputy (shift boss) to whom workmen are assigned for any shift or a competent person or persons authorised by the deputy (shift boss) shall at the end of that shift, unless there is any person then in the working area for a succeeding shift ensure that in that area—

(a) the ventilation is taking its proper course, and

(b) where appropriate, all lights are extinguished and any supply of electricity is cut off, except any light or supply of which the continuance is necessary for the safety of the mine.

26 ..

26. A deputy (shift boss) to whom workmen are assigned for any shift shall not leave the mine at the end of that shift if any workman is due to arrive in any working place in the working area for a succeeding shift within one hour after the departure of the last of the workmen assigned to him for the shift until he has conferred with the deputy (shift boss) succeeding him and has given that deputy (shift boss) all information in his possession necessary for the safety of the workmen who will be employed in any working place in that area during the next shift.

27 Inspection reports.

27. Every deputy (shift boss) or appointed person who has made a pre-shift inspection shall forthwith upon the completion thereof make and sign, in a book provided by the owner of the mine for the purpose, a report containing the information specified in Form No. 1 in the Second Schedule. The report shall be a full and accurate report of the inspection and shall, except in so far as it consists of printed matter, be in his own handwriting and in particular shall specify—

(a) the condition of roof and sides and of the ventilation in his working area, and

(b) whether or not he has found therein any flammable or noxious gas or other source of danger and, if found, particulars thereof.

28 ..

28. Every deputy (shift boss) to whom workmen are assigned for any shift shall forthwith after the end of that shift make and sign, in a book provided by the owner of the mine for the purpose, a report containing the information specified in Form No. 2 in the Second Schedule.

The report shall, except in so far as it consists of printed matter, be in his own handwriting and shall give a full and accurate account of the performance of all his duties during that shift, and shall include any information in his possession which is material to the proper working of the mine or to the safety or health of persons who may be employed in the working area.

29 Qualifications of deputies (shift bosses).

29. (1) Subject to Regulation 35 (6), no person shall be qualified to be appointed, or to be, a deputy (shift boss) unless he is the holder of—

(a) (i) a qualification specified in the First Schedule to these Regulations, or,

(ii) any other qualification of equivalent standard acceptable to the Minister, or

(b) a deputy's certificate.

(2) No person shall be qualified to be appointed, or to be, a deputy (shift boss) unless he has within the last preceding five years obtained a certificate that he was then able to make proper tests for flammable gas and able in so far as concerned his hearing to carry out his duties efficiently, being a certificate granted by an inspector or by a body approved by the Minister for that purpose:

Provided that a person shall not be required to have obtained a certificate as to ability to make tests for flammable gas if he is employed in a mine in which flammable gas is unknown.

(3) No person shall be qualified to be appointed or to be, a deputy (shift boss) unless he has within the last preceding three years obtained a certificate of proficiency in first-aid granted by a society, body or training organisation approved by the Minister for the purpose.

(4) The expenses incurred by a person who is employed as a deputy (shift boss) at a mine in obtaining a certificate described in either of the two last preceding paragraphs shall be borne by the owner of that mine.

(5) Every certificate required by the preceding provisions of this regulation to be held as a qualification by any person for the time being appointed a deputy (shift boss) at any mine shall be kept at the office at that mine or at such other place as may be approved by an inspector.

30 ..

30. (1) If in the case of a mine at which not more than thirty persons are employed below ground the number of persons employed thereat who may be appointed deputy (shift boss) in accordance with the provisions of the last preceding regulation is less by reason of sickness, holidays or other temporary cause than the number for the time being requisite for the full working of the mine, nothing in that regulation shall prevent any competent person being appointed being a deputy (shift boss) in that mine.

(2) Nothing in this regulation shall authorise a person appointed in pursuance thereof to be a deputy (shift boss) for a period exceeding three months.

(3) The manager of a mine shall give to the Inspector notice of the making of any appointment under this regulation in respect of that mine and of the name and address of the person appointed within seven days after the making of the appointment.

31 ..

31. (1) An inspector may grant a certificate (in these Regulations referred to as a deputy's certificate) to a person who complies with the provision of this regulation.

(2) An applicant for a deputy's certificate must:

(a) have reached the qualifying standard in the practical tests specified in paragraph (3) of this regulation;

(b) (i) have had not less than three years' practical experience below ground in a mine, of which not less than two years' was at the face of the workings, or

(ii) in the case of a mine of coal or other stratified mineral, have had not less than two years' practical experience below ground in such a mine, of which not less than one year was at the face of the workings, or, in the case of any other mine not being a mine of coal or other stratified mineral, have had not less than one year's appropriate practical experience below ground in such a mine, and the applicant in either case must possess special qualifications or experience; and

(c) have attained an age not less than twenty-one years.

(3) Such an applicant must satisfy the inspector that he—

(a) has sufficient knowledge of such of the following matters as are appropriate to enable him to perform the duties of a deputy (shift boss):

(i) methods of working and haulage;

(ii) nature of the atmosphere and mine gases; ventilation;

(iii) support of roof and sides; withdrawal of supports;

(iv) maintenance of direction of roadways;

(v) flame and electric safety lamps;

(vi) safety in use of machinery;

(vii) fires; fire-fighting equipment;

(viii) duties of a shot firer;

(ix) rules and regulations applying to safety and health in mines;

(b) can prime, charge and fire a shot; and

(c) can make reports adequate for a deputy (shift boss), orally and in writing, on inspections.

PART V. Inspections outside Deputies' (Shift Bosses) working areas.

32 ..

32. It shall be the duty of the manager of every mine to secure that competent persons, each of whom is qualified under Regulation 29 to be a deputy (shift boss) or is an official superior to the deputy (shift boss) but inferior to the manager, possessing the qualifications set out in Regulation II, are appointed by him and assigned to make the inspection specified in the next following regulation.

33 ..

33. A competent person appointed under the last preceding regulation shall ascertain by inspection the condition of the following parts of the mine below ground, in so far as they are not within any working area, at the times respectively specified, that is to say—

(a) in the case of a mine of coal or other stratified mineral, at intervals not exceeding twenty-four hours or in the case of a mine not being a mine of coal or other stratified mineral, at intervals not exceeding twenty-four hours (except during periods when no persons other than pump-minders, mechanics or electricians, or persons performing duties of a specialised nature are working below ground), every place normally passed by persons while going to or returning from a working place, and

(b) at intervals not exceeding seven days, every airway, travelway and road.

34 ..

34. (1) Every person who has made an inspection required by Regulation 33 (a) shall forthwith make and sign, in a book provided by the owner of the mine for the purpose, a report containing the information specified in Form No. 3 in the Second Schedule. The report shall be a full and accurate report of the inspection.

(2) Every person who has made an inspection required by Regulation 33 (b) shall forthwith make and sign, in a book provided by the owner of the mine for the purpose, a report containing the information specified in Form No. 4 in the Second Schedule. The report shall be a full and accurate report of the inspection.

(3) The reports referred to in paragraphs (1) and (2) of this regulation shall, except in so far as they consist of printed matter, be in the handwriting of the person who has made the inspection.

PART VI. Special provisions relating to shafts in the course of being sunk.

35 ..

35. (1) In relation to a mine or part of a mine consisting of a shaft in the course of being sunk the preceding regulations shall have effect subject to the following modifications.

(2) An inspection of a working area consisting of a shaft in the course of being sunk shall be made to ascertain the condition of every such part as regards the presence of gas (other than flammable gas which is known not to be present in the mine), ventilation, state of sides and general safety and such an inspection shall be completed before the commencement of any work in the shaft.

(3) An inspection of such a working area in accordance with paragraph (2) of this regulation shall be made whenever workmen have been withdrawn for shotfiring:

Provided that, in a mine to which section 63 of the Act applies, the deputy (shift boss) making such an inspection shall have with him a locked flame safety-lamp and a locked electric safety-lamp or a locked safety-lamp combining those two, being in every case a lamp for the time being approved by the Minister for the purpose of deputies' (shift bosses') inspections, and he shall not use any other lamp during his inspection and he may be accompanied by not more than two competent workmen as assistants.

(4) Regulations 20 and 23 shall not apply.

(5) The deputy (shift boss) in charge of the workmen in such a working area shall not be raised to the surface unless every workman assigned to him has been raised or is being raised with him to the surface, unless he has committed the charge of those workmen to a competent person who shall during the absence of the deputy (shift boss) perform the functions of the deputy (shift boss).

(6) In addition to a person qualified to be deputy (shift boss) under Regulation 29 (1), a person shall be qualified to be appointed and to be, a deputy (shift boss) for the purpose of this regulation if—

(a) he has attained the age of twenty-one years,

(b) he has had three years practical experience in the sinking of shafts or in operations which, in the opinion of an inspector, are of a sufficiently comparable nature,

(c) he holds the certificates required by paragraph (2) and (3) of that regulation and

(d) an inspector by notice served on the manager of the mine approves of the appointment:

Provided that a deputy (shift boss) appointed by virtue of this paragraph shall not be placed in charge of the workmen employed in any working area other than a working area consisting of a shaft in the course of being sunk.

PART VII. Revocations.

36 ..

36. The following are hereby revoked:

(a) the Order made under section 15 of the Coal Mines Act, 1911, on the 12th day of May, 1912, and relating to Firemen's, Examiners' and Deputies' Certificates;

(b) Regulations 35 to 62 of the General Regulations made under section 86 of the said Coal Mines Act on the 10th day of July, 1913;

(c) the Order prescribing the form of certificate for the purpose of section 15 (1) (c) of the said Coal Mines Act and made under that section on the 13th day of August, 1917;

and

(d) Regulation 15 of the Metalliferous Mines (General) Regulations, 1956 ( S.I. No. 273 of 1956 ).
