MERCHANT SHIPPING (CARGO SHIP SAFETY EQUIPMENT SURVEY) (AMENDMENT) RULES, 1994.

I, DAVID ANDREWS, Minister for the Marine, in exercise of the powers conferred on me by section 427 of the Merchant Shipping Act, 1894 (inserted by Section 11 of the Merchant Shipping (Safety Convention) Act, 1952 (No. 29 of 1952)), as amended by section 10 of the Merchant Shipping Act, 1966 (No. 20 of 1966) and by section 6 of the Merchant Shipping Act, 1981 (No. 33 of 1981), section 18 of the Merchant Shipping (Safety Convention) Act, 1952 , as amended by section 10 of the Merchant Shipping Act, 1981 , section 19 of the Merchant Shipping (Safety Convention) Act, 1952 as amended by section 11 of the Merchant Shipping Act, 1981 , and the Communications (Transfer of Departmental Administration and Ministerial Functions) Order, 1987 ( S.I. No. 91 of 1987 ), hereby make the following Rules:—

1. These Rules may be cited as the Merchant Shipping (Cargo Ship Safety Equipment Survey) (Amendment) Rules, 1994 and shall come into operation on the 3rd day of May, 1994.

2. The Merchant Shipping (Cargo Ship Safety Equipment Survey) Rules 1983 ( S.I. No. 312 of 1983 ), are hereby amended:

(1) by the substitution of the following definition for the definition of "safety equipment" in Rule 1 (2):

'"safety equipment' means life-saving appliances, fire appliances, lights, shapes, means of making sound signals, pilot ladders and associated equipment, mechanical pilot hoists, echo-sounder installations, radar installations, magnetic compasses, speed and distance measuring equipment, homing equipment, automatic radar plotting aids (ARPA), and rate of turn indicator installations;";

(2) by the substitution of the following definition for the definition of "safety rules" in Rule 1 (2):

"'safety rules' means the Merchant Shipping (Life-Saving Appliances) Rules, 1983 ( S.I. No. 302 of 1983 ), the Merchant Shipping (Life-Saving Appliances) Rules, 1983 (Amendment) Rules, 1993 ( S.I. No. 381 of 1993 ), the Merchant Shipping (Life-Saving Appliances) Rules, 1983 (Amendment) (No. 2) Rules, 1993, ( S.I. No. 382 of 1993 ), the Merchant Shipping (Life-Saving Appliances) Rules, 1993 ( S.I. No. 380 of 1993 ), the Merchant Shipping (Fire Appliances) Rules, 1967 ( S.I. No. 101 of 1967 ), the Merchant Shipping (Fire Appliances) (Amendment) Rules, 1983 ( S.I. No. 304 of 1983 ), the Merchant Shipping (Fire Appliances) (Post 1980 Ships) Rules, 1983 ( S.I. No. 303 of 1983 ), the Merchant Shipping (Fire Appliances) (Post 1980 Ships) (Amendment) Rules, 1985 ( S.I. No. 278 of 1985 ), the Merchant Shipping (Fire Protection) Rules, 1985 ( S.I. No. 279 of 1985 ), the Merchant Shipping (Fire Protection) (Amendment) Rules, 1990 ( S.I. No. 86 of 1990 ), the Collision Regulations (Ships and Water Craft on the Water) Order, 1984 ( S.I. No. 29 of 1984 ), the Collision Regulations (Ships and Water Craft on the Water) (Amendment) Order, 1993 ( S.I. No. 287 of 1993 ), the Signals of Distress (Ships and Water Craft on the Water) Rules, 1977 ( S.I. No. 234 of 1977 ), the Merchant Shipping (Navigational Equipment) Rules, 1985 ( S.I. No. 280 of 1985 ), the Merchant Shipping (Navigational Equipment) (Amendment) Rules, 1990 ( S.I. No. 84 of 1990 ), the Merchant Shipping (Pilot Ladders and Hoists) Rules, 1983 ( S.I. No. 314 of 1983 ) and the Merchant Shipping (Pilot Ladders and Hoists) Rules, 1993 ( S.I. No. 55 of 1993 );";

(3) by the substitution of the following definition for the definition of "tons" in Rule 1 (2):

"'tons' means gross tons and a reference to tons:

( a ) in relation to a ship having alternative gross tonnage under paragraph 12 of the Fourth Schedule to the Merchant Shipping (Tonnage) Regulations 1984 ( S.I. No. 369 of 1984 ) is a reference to the larger of those tonnages; and

( b ) in relation to a ship having its tonnage determined both under Part II and Regulation 16 of those Regulations is a reference to its gross tonnage as determined under Regulation 16 of those Regulations;".

EXPLANATORY NOTE.

These Rules amend the Merchant Shipping (Cargo Ship Safety Equipment Survey) Rules, 1983 ( S.I. No. 312 of 1983 ) and give effect in part to the Amendments to the International Convention for the Safety of Life at Sea, 1974 adopted on 20th November, 1981 by the International Maritime Organisation (IMO) and which came into force internationally on 1st September 1984. The safety equipment to be carried, and relevant safety rules with which a ship must comply, before a Cargo Ship Safety Equipment Certificate may be issued or endorsed are redefined. The Rules also amend the definition of "tons" to take account of the entry into force of the International Convention on Tonnage Measurement of Ships, 1969.
