I, Joe Walsh, Minister for Agriculture, Food and Rural Development, in exercise of the powers conferred on me by
section 3
of the
European Communities Act, 1972
(No. 27 of 1972) and for the purpose of giving effect to Council Directive 97/12 (EC)(1)
of 17 March 1997, Council Regulation (EC) No. 820/97(2)
of 21 April 1997. Commission Regulation (EC) No. 2628/97(3)
of 29 December 1997, Commission Regulation (EC) No. 2629/97(4)
of 29 December 1997, Commission Regulation (EC) No. 2630/97(5)
of 29 December 1997, Commission Regulation (EC) No. 494/98(6)
of 27 February 1998 and Commission Regulation (EC) No. 1678/98(7)
of 29 July 1998 insofar as they relate to the identification and registration of births of animals and the issue of animal passports and keeping of registers, hereby make the following Regulations :-

1. (1) These Regulations may be cited as the European Communities (Identification and Registration of Bovine Animals) (Amendment) Regulations, 2000.
|
| |
(2) These Regulations shall come into force on 11 February 2000.
|
| |
2. In these Regulations “the 1999 Regulations” means the European Communities (Identification and Registration of Bovine Animals) Regulations, 1999 (
S.I. No. 276 of 1999
).
|
| |
3. Regulation 4 (1) of the 1999 Regulations is hereby amended by the insertion of the following subparagraphs :
|
| |
(d) a passport in the format set out in the Fifth Schedule containing the information in paragraph (a) in respect of each animal whose birth has been notified after 1 January 2000 in accordance with Regulation 3 or Regulation 3, paragraph (1), of the 1996 Regulations, or otherwise;
|
| |
(e) with effect from 1 January 2000 a replacement passport in the format set out in the Sixth Schedule containing the information in paragraph (a) where he is satisfied it is in order to do so;
|
| |
(f) a passport in the format set out in the Sixth Schedule in respect of an animal notified after 1 January 2000 as being or as having been imported from a third country or from another Member State.
|
| |
4. Regulation 4 (3) of the 1999 Regulations is hereby amended by the insertion after “in accordance with paragraph 1 (b)” of:
|
| |
“or (1) (e)”.
|
| |
5. Regulation 5 of the 1999 Regulations is hereby amended by the insertion
|
| |
(1) after “(a) Regulation 4, paragraph (1) (a)” of :
|
| |
“or (1) (d)”.
|
| |
(2) after “(b) Regulation 4, paragraph (1) (b) or (1) (c)” of:
|
| |
“or (1) (e) or (1) (f)”.
|
| |
6. Where the Minister has issued, or caused to be issued, a passport for the purposes of the Council Regulation, in the format set out in the Fifth or Sixth Schedules, prior to the coming into effect of these Regulations, the provisions of Regulation 5 (as amended by these Regulations), 6, 7, 8, 9, 10, 11, 12, 13, 14, 15 and 16 of the 1999 Regulations shall also be applicable, mutatis mutandis, in the case of an animal in respect of which such passport has been issued, after the date of coming into force of these Regulations.
