S.I. No. 39/2003 - Statistics (National Employment Survey) Order 2003
I, Mary Hanafin, Minister of State at the Department of the Taoiseach, in exercise of the powers conferred on me by section 25 (1) of the Statistics Act 1993 (No. 21 of 1993) and the Statistics (Delegation of Ministerial Functions) Order 2002 ( S.I. No. 313 of 2002 ) for the purpose of giving effect to Council Regulation (EC) No. 530/1999 of 9 March 19991 and Commission Regulation (EC) No. 1916/2000 of 8 September 20002 , in so far as they relate to structural statistics on employees earnings, hereby order as follows: 1. (1) This Order may be cited as the Statistics (National Employment Survey) Order 2003. | ||||
(2) This Order comes into operation on 1 March 2003 and ceases to have effect on 30 September 2003. 2. This Order applies to undertakings which employ 3 or more persons, classified for statistical purposes under sections C, D, E, F, G, H, I, J, K, L, M, N and O of NACE Rev. 1, set out in the Annex to Council Regulation (EEC) No. 3037/90 of 9 October 19903 , as amended by Commission Regulation (EEC) No. 761/93 of 24 March 19934 , and to persons employed in those undertakings. 3. (1) An undertaking to which Article 2 of this Order applies is required to provide details, the general nature of which is specified in Schedule 1 to this Order. | ||||
(2) An employee to whom Article 2 of this Order applies is required to provide details, the general nature of which is specified in Schedule 2 to this Order. | ||||

Explanatory Note | ||||
Statistics (National Employment Survey) Order 2003 | ||||
The National Employment Survey (NES) will be carried out in March of this year and replaces the Structure of Earnings Survey which was last carried out in 1996. The NES will provide much-needed information on the distribution of individual employee earnings and on the factors which influence earnings levels. It will provide results which will be broken down by sector, region, occupation, age, sex, educational attainment, family status as well as many other important individual employee circumstances. It will cover all sectors of the economy and will show comparisons across economic sectors. | ||||
The purpose of the Order is to allow for the possibility of legal action against non-respondents. This would greatly increase response rates to the CSO and improve the overall quality of their statistical output both at National and European level. | ||||
