S.I. No. 215/2003 - Harbour Rates (Tralee and Fenit Pier and Harbour) Order 2003


I, Dermot Ahern, Minister for Communications, Marine and Natural Resources, in exercise of the powers conferred on me by section 104 of the Harbours Act 1946 (No. 9 of 1946) and the Communications (Transfer of Departmental Administration and Ministerial Functions) Order 1987 ( S.I. No. 91 of 1987 ) (as adapted by the Marine and Natural Resources (Alteration of Name of Department and Title of Minister) Order 2002 ( S.I. No. 307 of 2002 )), hereby order as follows:

1.         (1)      This Order may be cited as the Harbour Rates (Tralee and Fenit Pier and Harbour) Order 2003.

(2)      This Order comes into operation on 1 June, 2003.

2.         (1)      The rates set out in -

(a)      Schedule 1 to this Order are fixed as the maximum rates to be charged for goods, and

(b)      Schedule 2 to this Order are fixed as the maximum rates to be charged for tonnage on vessels,

by Tralee and Fenit Pier and Harbour Commissioners in respect of Tralee and Fenit Pier and Harbour.

(2)      Where the rates fixed under this Order are payable per tonne or per ton, lesser weights shall be chargeable at a weight calculated to nearest first decimal place.

(3)      A vessel sailing from Tralee and Fenit Pier and Harbour which puts back to the harbour due to stress of weather, without having accomplished its voyage, shall not on its return to the be, charged a rate fixed under this Order, where it has paid the appropriate rate before sailing.

3.         The following are revoked -

(a)      the Harbour Rates (Tralee and Fenit Pier and Harbour) Order 1954 ( S.I. No. 266 of 1954 ), and

(b)      the Harbour Rates (Tralee and Fenit Pier and Harbour Order 1997 ( S.I. No. 528 of 1997 ).
