AIR POLLUTION ACT 1987 (MARKETING, SALE AND DISTRIBUTION OF FUELS) (AMENDMENT) REGULATIONS 2004.

The Minister for the Environment, Heritage and Local Government, in exercise of the powers conferred on him by Sections 10, 14 and 53 of the Air Pollution Act 1987 (No. 6 of 1987), hereby makes the following Regulations:

Citation

1.  (1)  These Regulations may be cited as the Air Pollution Act 1987 (Marketing, Sale and Distribution of Fuels) (Amendment) Regulations 2004.

(2)  These Regulations, the Air Pollution Act 1987 (Marketing, Sale and Distribution of Fuels) Regulations 1998 ( S.I. No. 118 of 1998 ), the Air Pollution Act 1987 (Marketing, Sale and Distribution of Fuels) (Amendment) Regulations 2000 ( S.I. No. 278 of 2000 ) and the Air Pollution Act 1987 (Marketing, Sale and Distribution of Fuels) (Amendment) Regulations 2003 ( S.I. No. 111 of 2003 ) shall be construed together as one and may be collectively cited as the Air Pollution Act 1987 (Marketing, Sale and Distribution of Fuels) Regulations 1998 to 2004.

Entry into Force

2.  These Regulations shall come into force on the 15th day of November 2004.

Amendment to 2003 Regulations

3.  The First Schedule to the Air Pollution Act 1987 (Marketing, Sale and Distribution of Fuels) Regulations 1998 ( S.I. No. 118 of 1998 ) is hereby amended in respect of the Restricted Area of Tralee by the substitution of the following for the second indent of the included areas of the administrative County of Kerry:

“2. In the District Electoral District of Rathass, the townland of Ballinorig West.”.

EXPLANATORY NOTE.

(This note is not part of the Instrument and does not purport to be a legal interpretation.)

These Regulations amend the Air Pollution Act 1987 (Marketing, Sale and Distribution of Fuels) Regulations 2003 ( S.I. No. 111 of 2003 ).

These Regulations vary the areas of Tralee in which the sale of bituminous coal is prohibited.

The Regulations come into force on 15th November 2004.
