European Communities (Authorization, Placing on the Market, Use and Control of Plant Protection Products) (Amendment) (No. 4) Regulations 2005

I, Mary Coughlan, Minister for Agriculture and Food, in exercise of the powers conferred on me by section 3 of the European Communities Act 1972 ( No. 27 of 1972 ), for the purpose of giving effect to Commission Directive 2004/97/EC of 27 September 2004¹ , Commission Directive 2004/115/EC of 15 December 2004² and Corrigendum to Commission Directive 2004/115/EC of 15 December 2004³ hereby make the following regulations:

1.         These Regulations may be cited as the European Communities (Authorization, Placing on the Market, Use and Control of Plant Protection Products) (Amendment) (No. 4) Regulations 2005.

2.         The European Communities (Authorization, Placing on the Market, Use and Control of Plant Protection Products) Regulations 2003 ( S.I. No. 83 of 2003 ) are amended, in Regulation 2(1), by substituting for the definition of “Directive of 1991” the following-

Explanatory Note

(This note is not part of the instrument and does not purport to be a legal interpretation)

These Regulations give effect to Commission Directive 2004/97/EC of 27 September 2004 which amends Commission Directive 2004/60/EC as regards time limits. It also gives effect to Commission Directive 2004/115EC of 15 December 2004 and Corrigendum to Commission Directive 2004/115EC of 15 December 2004 which amend1 Council Directive 90/642/EEC as regards the maximum levels for certain pesticide residues
