PRIVATE SECURITY (LICENSING AND STANDARDS) REGULATIONS 2005 | ||||||||||||||||
The Private Security Authority, in exercise of the powers conferred on it by section 51 of the Private Security Services Act 2004 (No. 12 of 2004) and with the consent of the Minister for Justice, Equality and Law Reform, hereby makes the following regulations: 1. These Regulations may be cited as the Private Security (Licensing and Standards) Regulations 2005. 2. These Regulations come into operation on the 19th day of December 2005. 3. (1) In these Regulations, | ||||||||||||||||
“Act” means the Private Security Services Act 2004 ; | ||||||||||||||||
“door supervisor (licensed premises)” means a person who provides security services as a door supervisor at or in the vicinity of licensed premises; | ||||||||||||||||
“door supervisor (licensed premises) licence” means a licence authorising a person to perform the functions of a door supervisor (licensed premises); | ||||||||||||||||
“installer (intruder alarm)” means a person who is an installer of security equipment that consists of an electronic device which warns of an unauthorised presence or of entry or attempted entry on or in the vicinity of premises; | ||||||||||||||||
“installer (intruder alarm) licence” means a licence authorising a person to perform the functions of an installer (intruder alarm); | ||||||||||||||||
“licence” means a licence issued under these Regulations, and cognate words shall be construed accordingly; | ||||||||||||||||
“licensed premises” means: | ||||||||||||||||
(a) premises licensed for the sale of intoxicating liquor under the Licensing Acts 1833 to 2004, | ||||||||||||||||
(b) premises licensed under the Public Dance Halls Acts 1935 to 2003; | ||||||||||||||||
(c) premises licensed under the Gaming and Lotteries Acts 1956 to 1986; | ||||||||||||||||
(d) a club registered under the Registration of Clubs Acts 1904 to 2004; | ||||||||||||||||
(e) food premises, or a food stall or food vehicle, within the meaning of the Food Hygiene Regulations 1950 to 1989; | ||||||||||||||||
“person” means - | ||||||||||||||||
(a) a private security employer, or | ||||||||||||||||
(b) other person who is an independent contractor, | ||||||||||||||||
whether an individual, a body corporate or an unincorporated body of persons; | ||||||||||||||||
“security guard (monitoring centre)” means a person who as security guard monitors security equipment which consists of a continuously manned remote centre to which information concerning the status of one or more alarm systems is reported; | ||||||||||||||||
“security guard (monitoring centre) licence” means a licence authorising a person to perform the functions of a security guard (monitoring centre); | ||||||||||||||||
“security guard (static)” means a person who as security guard guards property for the purposes of preventing loss, damage or waste by crime, fire carelessness or flood; | ||||||||||||||||
“security guard (static) licence” means a licence authorising a person to perform the functions of a security guard (static). | ||||||||||||||||
(2) Unless defined otherwise, words and expressions used in these Regulations and in the Act have the same meaning as in the Act. 4. The following categories of licence may be issued by the Authority: | ||||||||||||||||
(a) door supervisor (licensed premises) licence, | ||||||||||||||||
(b) installer (intruder alarm) licence, | ||||||||||||||||
(c) security guard (monitoring centre) licence, | ||||||||||||||||
(d) security guard (static) licence. | ||||||||||||||||
5. (a) Following are the standards to be observed in the provision of security services by the following categories of licensee, in so far as those standards are applicable to the licensee concerned: | ||||||||||||||||
| ||||||||||||||||
(b) With effect from 1 April 2006, the following standards must also be observed in the provision of security services by the following categories of licensees in so far as those standards are applicable to the licensee concerned. | ||||||||||||||||

The Minister for Justice, Equality and Law Reform consents to the making of the foregoing Regulations. | ||||||||||||||||

These Regulations prescribe categories of licence and the standards to be observed by licensees in the provision of security services under the Private Security Services Act 2004 . |
