MISUSE OF DRUGS (EXEMPTION) (AMENDMENT) ORDER, 2006 | ||||||||
I, Mary Harney, Minister for Health and Children, in exercise of the powers conferred on me by section 3 of the Misuse of Drugs Act, 1977 (No. 12 of 1977), as adapted by the Health (Alteration of Name of Department and Title of Minister) Order, 1997, ( S.I. No.308 of 1997 ), hereby order as follows: 1. This Order may be cited as the Misuse of Drugs (Exemption) (Amendment) Order, 2006. 2. The Misuse of Drugs (Exemption) Order , 1988 ( S.I. No. 326 of 1988 ) is hereby amended as follows:- | ||||||||
(a) In Part 1 of the Schedule to the aforementioned Order, the following new paragraph is inserted: 3 Any substance, product or preparation including a Fungus of any kind or description, which contains psilocin or an ester of psilocin, where that substance or fungus is growing uncultivated. | ||||||||

The effect of this Order is to exempt from the provisions of Section 3 of the Misuse of Drugs Act, 1977 (which makes the possession of controlled drugs an offence) substances, products or preparations including those fungi of any kind or description, containing psilocin or an ester of psilocin (which are commonly described as “magic mushrooms”) in certain limited circumstances. |
