I, Micheál Martin, Minister for Enterprise, Trade and Employment in exercise of the powers conferred on me by
Section 3
of the
European Communities Act 1972
(No. 27 of 1972) and for the purpose of giving further effect to Council Directive 76/769/EEC of 27 July 19761
as amended by Directive 2005/59/EC of the European Parliament and of the Council of 26 October 20052
, Directive 2005/69/EC of the European Parliament and of the Council of 16 November 20053
, Directive 2005/84/EC of the European Parliament and of the Council of 14 December 20054
and Directive 2005/90/EC of the European Parliament and of the Council of 18 January 20065
hereby make the following Regulations:
1. (1) These Regulations may be cited as the European Communities (Dangerous Substances and Preparations) (Marketing and Use (Amendment) Regulations 2006.

(2) The Principal Regulations, the Regulations of 2003, the Regulations of 2004 and these Regulations may be cited together as the European Communities (Dangerous Substances and Preparations)(Marketing and Use) Regulations 2003 to 2006.
2. (1) In these Regulations -
|

“Principal Regulations” means the European Communities (Dangerous Substances and Preparations)(Marketing and Use) Regulations 2003 (
S.I. No. 220 of 2003
) as amended by the European Communities (Dangerous Substances and Preparations)(Marketing and Use)(Amendment) Regulations 2003 (
S.I. No. 503 of 2003
) and as amended by the European Communities (Dangerous Substances and Preparations)(Marketing and Use)(Amendment) Regulations 2004 (
S.I. No. 852 of 2004
);

“Regulations of 2003” means the European Communities (Dangerous Substances and Preparations)(Marketing and Use)(Amendment) Regulations 2003 (
S.I. No. 503 of 2003
);

| |
“Regulations of 2004” means the European Communities (Dangerous Substances and Preparations)(Marketing and Use)(Amendment) Regulations 2003 (
S.I. No. 852 of 2004
).

(2) A word or expression that is used in these Regulations and is also used in Council Directive 76/769/EEC of 27 July 19761
, Commission Directive 2005/59/EC of 26 October 20052
, Commission Directive 2005/69/EC of 16 November 20053
, Directive 2005/84/EC of the European Parliament and of the Council of 14 December 20054

has, unless the contrary intention appears, the same meaning in these Regulations as in the Directive concerned.
3. (1) Paragraphs (h), (i) and (j) of Regulation 4(1) of the Regulations of 2003 are amended by substituting “toxic to reproduction” for “toxic for reproduction” in each place where it occurs.

(2) Schedule 3 to the Principal Regulations, as amended, is further amended by substituting “toxic to reproduction” for “toxic for reproduction” in each place where it occurs.
4. (1) Schedule 1 to the Principal Regulations is amended by -
|
| |
(a) inserting the provisions set out in Schedule A after reference number 47,
|
| |
(b) inserting the provisions set out in Schedule B after reference number 49,
|
| |
(c) inserting the provisions set out in Schedule C after reference number 50.
|
| |
(2) Paragraph (1)(a) shall come into operation on 15 June 2007.
|
| |
(3) Paragraph (1)(b) shall come into operation on 1 January 2010.
|
| |
(4) Paragraph 1(c) and Regulation 4 shall come into operation on 16 January 2007.
5. Regulation 2 (1) of the Principle Regulations is amended by the insertion of the following definition -
|
| |
“childcare article” means any product intended to facilitate sleep relaxation, hygiene, the feeding of children or sucking on the part of children.
6. (1) Schedule 3 to the Principle Regulations is amended -
|
| |
(a) by inserting the notes set out in Schedule D to the Foreword in the said Schedule 3,
|
| |
(b) by substituting note K set out in Schedule E for Note K set out in the said Schedule 3,
|
| |
(c) under the heading “Point 29 (of Schedule 1) - Carcinogens List 1: category 1 carcinogens” -
|
| |
(i) by inserting the provisions set out in Schedule F,
|
| |
(ii) by substituting for entries with index numbers 024-001-000-0, 601-020-00-8, 612-022-00-3 and 612-042-00-2 those set out in Schedule G,
|
| |
(d) under the heading “Point 29 (of Schedule 1) - Carcinogens List 2: category 2 carcinogens” -
|
| |
(i) by inserting the provisions set out in Schedule H,
|
| |
(ii) by substituting the entries specified in Schedule I,
|
| |
(iii) by inserting the number 164058-22-4 in the column entitled ‘CAS number’ into the entry with index number 611-063-00-4,
|
| |
(iv) by deleting the entries set out in Schedule J,
|
| |
(e) under the heading “Point 30 (of Schedule 1) - Mutagens: List 4 category 2 mutagens” -

(i) by inserting the provisions set out in Schedule K,

(ii) by substituting the entries specified in Schedule L -

(f) under the heading “Point 31 (of Schedule 1) - Toxic to reproduction: List 5, category 1 substances toxic to reproduction”, by substituting for entries with index numbers 082-001-00-6 and 082-002-00-1 those set out in Schedule M,

(g) under the heading “Point 31 (of Schedule 1) - Toxic to reproduction: List 6, category 2 substances toxic to reproduction”-
|
| |
(i) by inserting the provisions set out in Schedule N,
|
| |
(ii) by substituting for entries with index numbers 048-006-00-2 048-008-003 and 603-063-00-8 those set out in Schedule O.

(2) Paragraph (1) shall come into operation on 24 August 2007.

1. Extender oils may not be placed on the market and used for the production of tyres or parts of tyres, if they contain:
— more than 1 mg/kg BaP, or
— more than 10 mg/kg of the sum of all listed PAHs.
These limits are regarded as kept, if the polycyclic aromatics (PCA) extract is less than 3 % by mass, as measured by the Institute of Petroleum standard IP346: 1998 (Determination of PCA in unused lubricating base oils and asphaltene free petroleum fractions — Dimethyl sulphoxide extraction refractive index method), provided that compliance with the limit values of BaP and of the listed PAHs, as well as the correlation of the measured values with the PCA extract, is controlled by the manufacturer or importer every six months or after each major operational change, whichever is earlier.
2. Furthermore, the tyres and treads for retreading manufactured after 1 January 2010 may not be placed on the market if they contain extender oils exceeding the limits indicated in paragraph 1.
These limits are regarded as kept, if the vulcanised rubber compounds do not exceed the limit of 0,35 % Bay protons as measured and calculated by ISO 21461 (Rubber vulcanised — Determination of aromaticity of oil in vulcanised rubber compounds).
3. By way of derogation, paragraph 2 shall not apply to retreaded tyres if their tread does not contain extender oils exceeding the limits indicated in paragraph 1.’

The name of the substance must appear on the label in the form of one of the designations given in Annex I to Directive 67/548/EEC (see Article 23(2)(a)).
|

In Annex I to Directive 67/548/EEC, use is sometimes made of a general description such as “… compounds” or “… salts”. In this case, the manufacturer or any other person who markets such a substance is required to state on the label the correct name, due account being taken of the chapter entitled “Nomenclature” of the Foreword.
|
| |
Directive 67/548/EEC also requires that the symbols, indications of danger, R- and S-phrases to be used for each substance shall be those shown in Annex I (Article 23(2)(c), (d) and (e)).
|
| |
For substances belonging to one particular group of substances included in Annex I to Directive 67/548/EEC, the symbols, indications of danger, R- and S-phrases to be used for each substance shall be those shown in the appropriate entry in that Annex I.
|
| |
For substances belonging to more than one group of substances included in Annex I to Directive 67/548/EEC, the symbols, indications of danger, R- and S-phrases to be used for each substance shall be those shown in both the appropriate entries given in Annex I. In cases where two different classifications are given in the two entries for the same hazard, the classification reflecting the more severe hazard classification is used.

Note D:

| |
Certain substances which are susceptible to spontaneous polymerisation or decomposition are generally placed on the market in a stabilised form. It is in this form that they are listed in Annex I to Directive 67/548/EEC.
|
| |
However, such substances are sometimes placed on the market in a non-stabilised form. In this case, the manufacturer or any person who places such a substance on the market must state on the label the name of the substance followed by the words “non-stabilised”.
|
| |
Note E:
|
| |
Substances with specific effects on human health (see Chapter 4 of Annex VI to Directive 67/548/EEC) that are classified as carcinogenic, mutagenic and/or toxic to reproduction in categories 1 or 2 are ascribed Note E if they are also classified as very toxic (T+), toxic (T) or harmful (Xn). For these substances, the risk phrases R20, R21, R22, R23, R24, R25, R26, R27, R28, R39, R68 (harmful), R48 and R65 and all combinations of these risk phrases shall be preceded by the word “Also”.

The classification and label shown for this substance applies to the dangerous property(ies) indicated by the risk phrase(s) in combination with the category(ies) of danger shown. The requirements of Article 6 of Directive 67/548/EEC on manufacturers, distributors, and importers of this substance apply to all other aspects of classification and labelling. The final label shall follow the requirements of Section 7 of Annex VI to Directive 67/548/EEC.

Directive 2005/59/EC is transposed through Regulation 3(1)(a) and Schedule A to these Regulations, which come into operation from 15 June 2007.

Directive 2005/69/EC is transposed through Regulation 3(1)(b) and Schedule B to these Regulations, which come into operation from 1 January 2010.
|
| |
Directive 2005/84/EC is transposed through Regulations 3(1)(c)and 4 and Schedule C to these Regulations, which come into operation from 16 January 2007.
|
| |
Directive 2005/90/EC is transposed through Regulation 5 and Schedules D to O to these Regulations, which come into operation from 24 August 2007.
