ETHICS IN PUBLIC OFFICE (DESIGNATED POSITIONS IN PUBLIC BODIES) (AMENDMENT) REGULATIONS 2008 | ||

I, BRIAN COWEN, Minister for Finance, in exercise of the powers conferred on me by sections 3 and 18 of the Ethics in Public Office Act 1995 (No. 22 of 1995) and, in relation to offices prescribed for the purposes of the said section 18, considering it necessary in the public interest to prescribe the offices specified in the following regulations, and after consultation with such other Ministers of the Government as I consider appropriate, hereby make the following regulations: | ||
1. (1) These Regulations may be cited as the Ethics in Public Office (Designated Positions in Public Bodies) (Amendment) Regulations 2008. | ||
(2) Regulation 2(a) is deemed to have come into operation on 14 June 2007. | ||
2. The Ethics in Public Office (Designated Positions in Public Bodies) Regulations 2004 ( S.I. No 698 of 2004 ) are amended: | ||
(a) by substituting the following for Regulation 5: | ||
“5. The amount of the salary at the second long service increment point of the higher executive officer standard (non-personal pension contribution) scale in the Civil Service is prescribed for the purposes of section 19(3)(a) of the Act.”, | ||
(b) by substituting the following for Regulation 6: | ||
“6. The following offices are prescribed for the purposes of section 18(3)(b)(v) of the Act— | ||
(a) Director of Public Prosecutions; | ||

EXPLANATORY NOTE | ||
(This note is not part of the Instrument and does not purport to be a legal interpretation). | ||
These regulations are made under the Ethics in Public Office Act 1995 (No. 22 of 1995) to apply the provisions of the Act to persons occupying specified positions of employment in the Civil Service. The Regulations designate certain positions in the Civil Service as “designated positions of employment” as defined in Section 18 of the Act. Persons occupying positions designated in these regulations are required, where a registrable interest or interests (as defined in the Second Schedule to the Act) exists, to furnish a statement of registrable interests to the relevant authority for the position (as defined in Section 18 of the Act). If no such registrable interest exists a ‘nil’ statement is requested. The regulations also take account of changes in the remuneration of special advisers, which is being brought into line with that of equivalent positions in the Civil Service. | ||
The Secretary General of a Department (Head of Office for a Civil Service Office) is the relevant authority to whom annual statements of interest must be furnished by every established civil servant occupying a designated position of employment in a grade below Secretary General level in that Department or Office. Secretaries General must furnish their statements to the Secretary General (Public Service Management & Development) in the Department of Finance. |
