DIPLOMATIC AND CONSULAR FEES (AMENDMENT) REGULATIONS 2009

Notice of the making of this Statutory Instrument was published in

“Iris Oifigiúil” of 3rd February, 2009.

I, MICHEÁL MARTIN, Minister for Foreign Affairs, in exercise of the powers conferred on me by section 3 of the Diplomatic and Consular Officers (Provision of Services) Act 1993 (No. 33 of 1993), as amended by section 28 of the Passports Act 2008 (No. 4 of 2008), and with the consent of the Minister for Finance, hereby make the following regulations:

1. (1) These Regulations may be cited as the Diplomatic and Consular Fees (Amendment) Regulations 2009.

(2) These Regulations shall come into operation on 1 February 2009.

2. In these Regulations—

“emergency passport” has the meaning assigned to it by the Passports Act 2008 ;

“emergency travel certificate” has the meaning assigned to it by the Passports Act 2008 .

3. The Diplomatic and Consular Fees Regulations 2001 ( S.I. No. 117 of 2001 ) (as amended by the Diplomatic and Consular Fees (Amendment) Regulations 2005 ( S.I. No. 391 of 2005 )) are amended—

(a) in Regulation 9, by substituting for paragraph (b) the following:

“(b) where the service for which the fee is chargeable is rendered for, or on behalf of, a person who is in straitened circumstances or the levying of the fee would for other reasons constitute a serious hardship or the waiver is otherwise desirable on compassionate grounds;”

(b) in Part II of the Second Schedule, by substituting the following for the matter at Reference Number 5—

For processing an application for a working holiday authorisation—(a) in the case of a citizen of the United States of America(b) in the case of a citizen of any other state

(c) by the substitution of the Schedule set out in the Schedule to these Regulations for Part 1 of the Second Schedule.

For the issue of an emergency passport to a person over 18 years of age by the relevant Passport Office, diplomatic mission or consular post outside its normal hours of opening.(This fee is charged for any attendance on weekends and public holidays)In addition, the applicable fee specified at reference number 1 or 2 in this Part for the subsequent issue of a passport shall be payable.The fee specified at reference number 12 in the First Schedule to the Diplomatic and Consular Fees (Amendment) Regulations 2001 (as amended by the Diplomatic and Consular Fees (Amendment) Regulations 2004) shall not be charged for the issue of a passport in these circumstances

For the issue of an emergency passport to a person under 18 years of age by the relevant Passport Office, diplomatic mission or consular post outside its normal hours of opening.(This fee is charged for any attendance on weekends and public holidays)In addition, the applicable fee specified at reference number 3 or 4 in this Part for the subsequent issue of a passport shall be payable.The fee specified at reference number 12 in the First Schedule to the Diplomatic and Consular Fees (Amendment) Regulations 2004 shall not be charged for the issue of a passport in these circumstances

For the issue of a passport to a person over 18 years of age by the relevant Passport Office, diplomatic mission or consular post during normal hours of opening on the same day that the application was submitted or on the day after the application was submitted.In addition, the applicable fee specified at reference number 1 or 2 in this Part shall be payable

For the issue of a passport to a person under 18 years of age by the relevant Passport Office, diplomatic mission or consular post during normal hours of opening on the same day that the application was submitted or on the day after the application was submitted.In addition, the applicable fee specified at reference number 3 or 4 in this Part shall be payable

For the issue of an emergency travel certificate

€15.00

11.

For the issue of a European Union Emergency Travel Document, valid for a single journey

The purpose of these Regulations is to amend the Diplomatic and Consular Fees Regulations 2001, as amended, to provide for changes in the fee structure and increases in the fees for passports, travel documents and working holiday authorisations.
