I, BRENDAN SMITH, Minister for Agriculture, Fisheries and Food, in exercise of the powers conferred on me by section 3 of the European Communities Act 1972 (No. 27 of 1972), for the purpose of giving effect to Commission Directive No. 2008/124/EC of 18 December 2008 1 , hereby make the following regulations: | ||
1. These Regulations may be cited as the European Communities (Seed of Oil Plants and Fibre Plants) (Amendment) Regulations 2009. | ||
2. The European Communities (Seed of Oil Seed Plants and Fibre Plants) Regulations 2003 ( S.I. No. 280 of 2003 ) are amended by the insertion, after Regulation 5, of— | ||
“5A. A person shall not place on the market seed of soya bean (Glycine max (L.) Merr.) or linseed (Linum usitatissimum L.) unless the seed has been certified as— | ||
(a) basic seed, | ||
(b) certified seed, first generation, or | ||
(c) certified seed, second generation.”. | ||

These Regulations amend Council Directive 2002/57/EC by limiting the marketing of seed of linseed or soya bean to seed which has been officially certified as “basic seed” or “certified seed”. | ||
