RABIES (IMPORTATION, LANDING AND MOVEMENT OF ANIMALS) (AMENDMENT) ORDER, 2009

Notice of the making of this Statutory Instrument was published in

“Iris Oifigiúil” of 10th July, 2009.

I, BRENDAN SMITH, Minister for Agriculture, Fisheries and Food, in exercise of the powers conferred on me by sections 3 and 30 of the Diseases of Animals Act, 1966 (No. 6 of 1966), hereby order as follows:

1. This Order may be cited as the Rabies (Importation, Landing and Movement of Animals) (Amendment) Order, 2009.

2. In this Order “the Principal Order” means the Rabies (Importation,Landing and Movement of Animals) Order, 1972 ( S.I. No. 16 of 1972 ).

3. The Principal Order is hereby amended by the substitution of the following for Article 6:

“6. Article 5 of this Order shall not apply in respect of—

(a) the importation or landing of an animal which is shown to the satisfaction of the Revenue Commissioners to have been brought directly to the State from Northern Ireland or Great Britain, or

(b) an animal which is transhipped in a port or transferred from an aircraft to any part of an airport or from one aircraft to another aircraft in an airport under and in accordance with a permission in writing obtained from an inspector, authorised person or officer of Customs and Excise.”

This Order amends the Rabies (Importation, Landing and Movement of Animals) Order, 1976 by removing the requirement for an import licence from Great Britain, in respect of imports of animals to which this Order applies.
