BRUCELLOSIS IN CATTLE (GENERAL PROVISIONS) (AMENDMENT) ORDER 2009

Notice of the making of this Statutory Instrument was published in

I, BRENDAN SMITH, Minister for Agriculture, Fisheries and Food, inexercise of the powers conferred on me by sections 3 and 27 of the Diseases of Animals Act 1966 (No. 6 of 1966) as adapted by the Agriculture and Food (Alteration of Name of Department and Title of Minister) Order 2007 ( S.I. No. 707 of 2007 ), hereby make the following order:

1. This Order may be cited as the Brucellosis in Cattle (General Provisions) (Amendment) Order 2009.

2. The Brucellosis in Cattle (General Provisions) Order 1991 ( S.I. No. 114 of 1991 ) is amended—

(a) by the substitution, for Article 18(2) and (3), of—

“(2) An eligible female animal aged 18 months or more or aneligible male animal aged 24 months or more may not be moved into or out of a holding other than directly to a premises at which it is to be slaughtered unless—

(a) the animal has passed a blood test within the period of 60 days prior to the day on which it is moved, and

(b) the date of the blood test is specified on the passport or cattle identity card issued in respect of the animal or the movement permit that accompanies the animal.

(3) A bull aged 24 months or more or a female animal aged 18 months or more may be sold not more than once, whether by public or private sale, during the period of 60 days commencing on the date of a blood test referred to in paragraph (2) of this Article.”

This Order provides for (i) changes to be made to the age thresholds for cattle to be tested for Brucellosis and (ii) an extension of the 30 day pre-movement test to 60 days.
