S.I. No. 444/2025 - European Union (Marine Equipment) (Amendment) Regulations 2025


Notice of the making of this Statutory Instrument was published in

“Iris Oifigiúil” of 3rd October, 2025.

I, DARRAGH O’BRIEN, Minister for Transport, in exercise of the powers conferred on me by section 3 of the European Communities Act 1972 (No. 27 of 1972), and for the purpose of giving further effect to Directive 2014/90/EU of the European Parliament and of the Council of 23 July 20141 , as amended by Commission Delegated Directive (EU) 2021/1206 of 30 April 20212 , hereby make the following regulations:

1. These Regulations may be cited as the European Union (Marine Equipment) (Amendment) Regulations 2025.

2. The European Union (Marine Equipment) Regulations 2017 ( S.I. No. 177 of 2017 ) are amended –

(a) in Regulation 2(1) –

(i) by inserting after the definition of “Commission” the following:

“‘Commission Implementing Regulation’ means an implementing act of the Commission, in the form of a Commission Regulation, laying down rules for the application of the Directive, as regards design, construction and performance requirements and testing standards for marine equipment, which is adopted in accordance with Article 35(2) of the Directive;”,

and

(ii) by inserting after the definition of “importer” the following:

“‘international instruments’ means the international conventions, together with the resolutions and circulars of the International Maritime Organisation giving effect to those conventions in their up-to-date version, and the testing standards;”,

(b) in Regulation 10(2), by substituting for subparagraph (b) (inserted by Regulation 2 of S.I. No. 580 of 2024 ) the following:

“(b) have the conformity assessment carried out, through a notified body, using one of the procedures referred to in Article 15(2)(a) or (b) of the Directive and the modules for conformity assessment set out in the Annex to the most recently adopted Commission Implementing Regulation,”,

and

(c) in Regulation 46 (as amended by Regulation 5 of S.I. No. 625 of 2021 ), by inserting after paragraph (2) the following:

“(3) Transitional periods shall be allowed for marine equipment, which is specified in the Commission Implementing Regulation referred to in Regulation 10(2)(b), and which is in compliance with the requirements for type-approval in force in the State before the date indicated in the Commission Implementing Regulation, so that the marine equipment may continue to be placed on the market and on board an Irish ship until the applicable date as indicated in the Commission Implementing Regulation.”.

3. The European Union (Marine Equipment) (Amendment) Regulations 2024 ( S.I. No. 580 of 2024 ) are revoked.

EXPLANATORY NOTE

(This note is not part of the Instrument and does not purport to be a legal interpretation.)

These Regulations amend the European Union (Marine Equipment) Regulations 2017 ( S.I. No. 177 of 2017 ), which give effect to Directive 2014/90/EU on marine equipment, known as the Marine Equipment Directive.

The amendment replaces the reference to a particular Commission Implementing Regulation, in Regulation 10(2)(b), with a general reference to “the most recently adopted” Commission Implementing Regulation, to take account of the annual adoption by the European Commission of a new Implementing Regulation to update the list of items of marine equipment that have become subject to harmonised EU requirements pursuant to the Marine Equipment Directive.

The amendment also adds a definition for the term “international instruments” to provide clarity as to its meaning; and re-introduces a reference to the transitional periods that are specified in the annual Commission Implementing Regulation, during which certain items of marine equipment can continue to be placed on the market and on board an Irish ship.
