AN ACT TO MAKE FURTHER AND BETTER PROVISION IN RESPECT OF THE REMUNERATION AND EXPENSES OF SUPERINTENDENT REGISTRARS, ASSISTANT SUPERINTENDENT REGISTRARS, REGISTRARS, AND ASSISTANT REGISTRARS OF BIRTHS AND DEATHS. [24th July, 1936.]

BE IT ENACTED BY THE OIREACHTAS OF SAORSTÁT EIREANN AS FOLLOWS:—
|

Local authority.
|
1.—In this Act the expression “local authority” means a body in whom is vested the administration of the relief of the poor and, when used in relation to a superintendent registrar, assistant superintendent registrar, registrar, or assistant registrar, means the body in whom is vested the said administration in the district of such superintendent registrar, assistant superintendent registrar, registrar or assistant registrar, as the case may be.

Liability of local authorities for certain expenses.
|
2.—(1) Every superintendent registrar, assistant superintendent registrar, registrar, and assistant registrar who is required by section 28 of the Registration of Births and Deaths (Ireland) Act, 1863, to cause the matters mentioned in that section to be placed on some conspicuous place on or near the outer door of his dwelling-house or known place of business shall comply with that provision of the said section by—

(a) procuring and maintaining a board of suitable size and having the said matters painted thereon, and
|
| |
(b) causing such board so painted as aforesaid to be placed and kept in some such conspicuous place as is mentioned in the said section.

(2) All expenses necessarily and properly incurred after the passing of this Act by a superintendent registrar, assistant superintendent registrar, registrar, or assistant registrar in complying in the manner appointed by this section with the relevant provision of section 28 of the Registration of Births and Deaths (Ireland) Act, 1863, shall be repaid on demand to such superintendent registrar, assistant superintendent registrar, registrar or assistant registrar (as the case may be) by the local authority.

Remuneration of registrars by local authorities.
|
3.—(1) As on and from the date of the passing of this Act, every local authority shall pay to every registrar for the purposes of the Births and Deaths Registration Acts (Ireland), 1863 to 1880, whose district is situate in or is co-terminous with the functional area of such local authority an allowance (in addition to any remuneration payable to such registrar under any other Act), in respect of every year during which or any part of which such registrar has held office, of whichever of the following amounts is applicable, that is to say:—

(a) if such registrar has held office during the whole of such year—eight pounds, or
|
| |
(b) if such registrar has held office during part only of such year—an amount bearing to eight pounds the same proportion as the said part of such year bears to one year.

(2) The allowance payable under this section to a registrar who holds office at the passing of this Act shall commence on the date of such passing, and every such registrar shall, for the purpose of calculating the amount payable to him in respect of such allowance, be deemed to have begun to hold office on the said date.

Expenses of local authorities.
|
4.—All expenses incurred by a local authority under this Act shall be raised and defrayed in the manner in which expenses incurred by such local authority in the administration of the relief of the poor are raised and defrayed.

Short title and collective citation.
|
5.—(1) This Act may be cited as the Registration of Births and Deaths Act, 1936.
|

(2) The Births and Deaths Registration Acts (Ireland), 1863 to 1880, and this Act may be cited together as the Births and Deaths Registration Acts, 1863 to 1936.
|
